ABYA Academy & British Marine: Practical Yacht Brokers Course

This two-day Practical Yacht Brokers  course is aimed at Yacht Brokers who have a degree of industry experience at listing and selling boats.

In-depth discussions will take place on the subjects of marine Law,  Anti-Money Laundering and KYC, Insurance, VAT and RCD; making sure attendees can demonstrate the knowledge and application of the necessary legal, financial and tax documentation required to pass on a good legal title when brokering a vessel.   

Other topics include:

  • Selling techniques
  • Conflict management
  • How to use social media and digital marketing to maximise sales
  • Details on selling new, used and part exchange vessels and the different financing options available to clients
  • Tricky negotiations towards the end of a sale
  • Sea trials and the IPV Code
  • The role the Marine Surveyor plays in the brokering process, including MCA coding and the selling of commercial vessels.

There will be a Q&A session with an experienced broker. This industry expert will be available to share their decades of experience and answer any burning questions.

The YDSA Northern Forums are held twice a year and always take place on the same day - the first Thursday in March and the first Thursday in November.

The meet usually takes place in the North East and topics cover all aspects of surveying and boats.

Abya is a professional association for yacht brokers, dealers and agents, with over 150 members in the uk and abroad. members sell new and second-hand boats from day boats to superyachts, and are all experienced professionals..

Many ABYA members have attended the intensive, industry-leading ABYA Practical Yacht Brokerage course, and all are required to keep their skills and knowledge up to date with Continuous Professional Development (CPD). For the security of both buyer and seller, ABYA members are required to set up a client account with their bank that holds client monies in trust and does not form part of the broker's own accounts. ABYA provides standard documents for the sale/purchase and listing of boats while all ABYA members hold Professional Indemnity and Public Liability Insurance. ABYA members work to the ABYA Code of Practice and ABYA operates a Customs Warehousing Scheme allowing brokers to offer ex-VAT boats for sale in the UK.

ABYA Members are industry professionals and will provide advice and assistance with the following: The type of boat that is best for you, negotiation following the survey findings, title documentation, VAT evidence, RCD requirements, finance - obtaining a loan, finance - paying off an outstanding loan on completion of the sale, acting as stakeholder for the deposit using a designated Client Account, closure or transfer of British Registration (Part 1) as well as completion of the sale and payment of the balance to the vendor.

ABYA PROFESSIONAL YACHT BROKERS

ABYA members are professional yacht brokers, not just introducing agents, and there is no  brokerage fee  until the sale is completed. They will visit your boat so they can talk knowledgeably to potential buyers and ensure you receive first class marketing advice, checking the legal paperwork so the boat is offered with correct title, RCD and VAT status evidence. By managing the sale both Vendor and Purchaser will be assisted by the broker to achieve a satisfactory outcome, with the new owner having clear legal title. ABYA members have access to the current ABYA contracts, available only to members. ABYA members charge a fee for services which includes visiting, photographing and listing your boat, advertising on their website and various portals and magazines, liaising with potential buyers and showing the boat, providing access for the surveyor and liaison between the parties and the surveyor on any defects found to achieve an outcome acceptable to all parties. On completion they provide a Bill of Sale to pass clear legal ownership. They also have access to the ABYA Customs Warehouse scheme (authorized by HMRC) which allows non-VAT paid boats to be offered for sale in the UK. This is particularly useful for clients bringing in boats for sale from overseas.

ABYA has almost 200 members in the  UK and abroad  and they variously specialize in new and second-hand boats from day boats to large yachts. Many have attended the ABYA Professional Yacht Brokerage intensive 2 day course and members keep their knowledge up to date by undertaking  Continuous Professional Development (CPD) .

Association of Brokers and Yacht Agents launches training courses

The Association of Brokers and Yacht Agents (ABYA) is relaunching its ABYA Academy, including three new professional development courses for yacht brokers.

James Brown, the Association’s new training coordinator has established a comprehensive series of courses with input from members of the ABYA Committee. ABYA says the result is a ‘carefully compiled programme which will provide yacht brokers with the most up-to-date and pertinent information to support their career progression.’

The new courses are:

  • Essential Elements for the New Yacht Broker (online)
  • Practical Yacht Brokerage (in-person)
  • Advanced Learning for the Experienced Yacht Broker (in-person)

Attendees of the courses will receive training delivered by a host of industry experts who will cover a range of practical and interactive topics, including brokerage management; registration, VAT and RCD; client accounts, AML, KYC; and law and insurance.

The ABYA Academy courses are accessible to both ABYA members and non-members. The first course, Essential Elements for the New Yacht Broker (online), begins on 9 July 2023 and is available to book now .

“The ABYA Academy is one of the many integral benefits we offer at the ABYA,” says Peter Norris, ABYA chair. “We are proud to be able to launch these new courses, which will provide all yacht brokers with the essentials they need to progress and achieve in their professions.”

The Association of Brokers and Yacht Agents (ABYA) is an association that represents professional yacht brokers, dealers and also new boat salespeople. ABYA members must have demonstrated knowledge and application of the necessary legal, financial and tax documentation required to pass on a good legal title when buying a vessel to become a member.

The importance of being an ABYA broker

Sitting proudly at the top of our website is a blue and white logo belonging to ABYA; the Association of Brokers & Yacht Agents . ABYA is one half of the YBDSA – Yacht Brokers & Designers Association with the other half being the YDSA – Yacht, Designers & Surveyors Association . This historic association was formed in 1912 and exists to support, guide and oversee the actions of their member brokers, surveyors and designers. Unlike many trade associations which cater purely for the corporate level, the YBDSA and more specifically ABYA exists for the individual broker and works to provide training, continuous professional development, up-to-date contracts, direct links to customs and registry bodies, dispute resolution and networking opportunities for their members. ABYA memberships range from probationary through to accredited and full with the Association overseen by an executive committee of fellow brokers and the YBDSA’s long-serving CEO Jane Gentry. Grabau International’s Alex Grabau and Mark Cameron reside on the current committee and work to ensure that all services provided by Grabau International are following ABYA’s Codes of Practice .

With yacht brokerage being largely unregulated, the existence of associations such as ABYA plays a vital part ensuring good professional services and accountability. All ABYA brokers must apply to the committee for membership, demonstrating evidence of their work, supported by independent references and they must hold appropriate professional indemnity, and public liability insurances and show provision of clearly-separated client accounts for holding client monies during transactions. The Sale & Purchase Agreements used by ABYA brokers are commonly regarded as being some of the best available and are unique to the association, written under English law (the preferred jurisdiction for all large yacht contracts) and based on sound and fair logic and clear English.

Career Pathway

Career path: There is not one single defined career path. In larger yachts many professional yacht crew retrain as yacht brokers in order to be able to come ashore and yet remain in contact with the marine world.

Salary: Can be from a starting level of commission only up to huge sums (millions) for a successful few who sell superyachts. The average annual salary for a yacht and small craft broker in the United Kingdom is around £38,000.

Duties: Finding clients who wish for their yacht to be sold, checking all legal aspects of the right to sell the vessel, obtaining a detailed and accurate description of the vessel, and presenting it in the best possible manner (without misleading). Promoting the vessel to obtain interest and organising viewings. Acting as the intermediary between buyers and sellers and being the glue that holds a sale together through the difficult times.

Toby maclaurin.

Toby began his maritime career as a trainee shipwright with Coombes Boatyard in the UK restoring and maintaining mainly classic yachts. A chance meeting with a yacht broker led to a part-time brokerage role at Ancasta International Boat Sales while undertaking an HND in Maritime Leisure Management at the College of Maritime studies in Warsash. Full time employment with Ancasta followed along with senior sales, business development and marketing roles at yacht builder Premier Yachts and then for Opal Marine, before joining superyacht broker and yacht charter specialist Cavendish White in 2002.

Following the Ocean Independence acquisition of Cavendish White in 2008, Toby is now Director of Sales and Marketing in addition to being a Group Board Member and Shareholder of the leading superyacht group and primarily based at the Zürich office in Switzerland. The role as Director of Sales and Marketing is exceptionally varied and primarily involves Toby providing day to day business and troubleshooting support for the group’s 50+ sales and charter brokers across 13 international locations.

Toby has served on the council of ABYA (Association of British Yacht Agents) and was elected to the MYBA (The Worldwide Yachting Association) governing board in March 2008, he then completed 4 years as MYBA President followed by 4 years as Chairman of the association’s commercial company All Yachting SAS, that owns and operates Yachtfolio.com and the MYBA Charter Show.

He has spoken at a number of high profile events and meetings, including the Future of Superyachts Forum, The Superyacht Owners Summit, Rothschild Private Bank annual client meeting, Posidonia Sea Forum and a special meeting of EU tax officials.

As an enthusiastic yachtsman, he has sailed extensively in the Mediterranean and Caribbean, he also has also completed two Atlantic crossings in small sailing yachts.
