Having initially studied Naval Architecture in Southampton before graduating with a degree in Marine Management, Alex went on to work with one of Europe’s leading largest brokerage houses where he remained for 15yrs as their Senior Broker. During this period, Alex also completed his first trans-Atlantic crossing as part of the World Cruising Club’s ARC (Atlantic Rally for Cruisers). With an international reputation for the very highest professional and knowledgeable service in the specialist field of high-quality blue water and cruising yacht brokerage, Alex started Grabau International Yacht Brokerage & Conveyancing at the beginning of 2015 to continue doing what he loves best.

A fellow and full broker member of ABYA, Alex is also a long-standing member of the ABYA committee, with particular interests in the development of sale & purchase contracts and broker training. Alex has also previously sat on the British Marine Federation’s Boat Retailers and Brokerage Association (BRBA) committee and was one of the first brokers in the UK to receive the ABYA/BRBA Boat Sales Qualification which is an industry-led qualification designed to provide recognition for the professionalism of yacht brokers.

Having sailed since he was a young child Mark pursued a career in the marine industry after leaving school. Jascha Bach

Jascha has been a competitive regatta sailor since childhood. Moving up from Optimists through 420s and then 470s, he graduated towards yacht racing while studying law at the University of Amsterdam. Following his graduation, Jascha joined prestigious Dutch superyacht broker Van der Vliet before gaining his DOC dor Yachtbroker and becoming a sworn and certified broker in the Netherlands in 2001. In 2000, Jascha founded Bach Yachting and built the company into one of Europe’s best-known performance yacht brokerages before joining Grabau International in 2022.

Away from the office, Jascha is a highly successful yacht racer, winning the ORC Worlds in 2016 aboard his Italia Yachts 9.98, taking 3rd in the 2012 ORC worlds aboard his Salona 37 and taking several Dutch Championships with his Bach Yachting racing team. More recently, Jascha has returned to his roots and races in the Finn class at an international level, while also enjoying more leisurely cruising aboard his S&S Swan 57.

Lucio Pellegrini

Lucio was born near the famous sailor’s area of Santa Lucia in Naples, just a few steps from their prestigious yacht clubs. Having started out his sailing career aboard his father’s yachts, he went on to work as a professional yacht captain and engineer aboard a variety of different yachts in the Mediterranean, taking in a diverse range of activities including competitive regattas, deliveries and private charters.

A graduate in industrial engineering, Lucio went on to complete a masters in Yacht Design at the University of Pisa as well as more recently a diploma in Yacht Brokerage from the Maritime Training Academy. A commercially endorsed RYA Yachtmaster, Lucio enjoys year-round sailing around the waters of the Balearics. Lucio now splits his time between Grabau International's Palma office and Barcelona , covering all of the Balearics and Southern Spain.

Vittorio Papa

Vittorio was born in a family of seafarers and yachtsmen. International dinghy sailing wins and experiences in Olympic and highly technical sailboats, fired out Vittorio's interest for the science behind sailing and performance. He then went on to complete a master's degree with top-grade from University of Naples and an MSc from University of Southampton in Naval Architecture.

Before founding Spinta Studio in 2020, Vittorio was Senior Naval Architect for Hoek Design for seven years contributing to ground-breaking superyacht projects like Elfje, the J-Class Topaz and Svea, Meraki, the explorer MY Blue II among many others.

In 2016, he moved to Mallorca to follow more closely the evolution of the racing J-Class fleet and other superyachts programs.

Regular at most regattas and boat shows, alongside his involvement with Grabau International Palma, Vittorio is the founder of the Palma-based design & naval architecture company Spinta Studio.

Matias Renlund

Matias started sailing at a young age and continued with racing for the National team of Finland. Afterwards, he continued with offshore sailing and regattas with Swan yachts. Studying Naval Science at Aland Island and continuing a career at sea with oil tankers, ice breakers and sailing passenger ships was always something he dreamt of doing. His strong marine knowledge combined with his training in the Finnish Navy Special Forces in Recon division makes him a dedicated leader and focused professional with a passion for the sea.

In addition to running Grabau International Scandinavia and subdivision in Marbella, Matias is also co-founder and managing director of Nordic Boathouse, a business specializing in high variety of blue-water sailing yachts and high quality motor yachts worldwide, also representing as the global agents for Ocean Explorer Catamarans and CMY powerboats.

Matias is based in Gothenburg,  Sweden  and splits his time between there and Grabau International Scandinavian's main office in Helsinki, Finland.

Jonas has always been close to the water. He entered the first regatta at the age of 6. After this, he continued his ambition with sail racing with the National team of Finland. Aside from his work with us, Jonathan is also a practicing solicitor and partner in the renowned City of London law firm Keystone Law. In that capacity, Jonathan routinely advises marine businesses, crew and other leisure marine operators such as yacht management companies and marina owners as well as assisting banks and private individuals in the yacht and superyacht industry.

Prior to becoming a lawyer, Jonathan spent twelve years at sea, firstly as a deck officer with BP Shipping and then as a nuclear submarine officer in the Royal Navy. ABYA PROFESSIONAL YACHT BROKERS

ABYA members are professional yacht brokers, not just introducing agents, and there is no  brokerage fee  until the sale is completed. They will visit your boat so they can talk knowledgeably to potential buyers and ensure you receive first class marketing advice, checking the legal paperwork so the boat is offered with correct title, RCD and VAT status evidence. By managing the sale both Vendor and Purchaser will be assisted by the broker to achieve a satisfactory outcome, with the new owner having clear legal title. ABYA members have access to the current ABYA contracts, available only to members. ABYA members charge a fee for services which includes visiting, photographing and listing your boat, advertising on their website and various portals and magazines, liaising with potential buyers and showing the boat, providing access for the surveyor and liaison between the parties and the surveyor on any defects found to achieve an outcome acceptable to all parties. On completion they provide a Bill of Sale to pass clear legal ownership. They also have access to the ABYA Customs Warehouse scheme (authorized by HMRC) which allows non-VAT paid boats to be offered for sale in the UK. This is particularly useful for clients bringing in boats for sale from overseas.

ABYA has almost 200 members in the  UK and abroad  and they variously specialize in new and second-hand boats from day boats to large yachts. Many have attended the ABYA Professional Yacht Brokerage intensive 2 day course and members keep their knowledge up to date by undertaking  Continuous Professional Development (CPD) .

ABYA’s Code of Practice

The Association of Brokers and Yacht Agents (ABYA) exists to promote the highest standards of professionalism and expert knowledge in the field of yacht sales, and expects high standards of its members.

So if you are thinking of  buying  or  selling a boat , get professional advice from an ABYA member:

  • Client Account  – For the security of both buyer and seller, ABYA members set up a special secure account with their bank that holds client monies on behalf of the parties which does not form part of the broker’s own accounts
  • ABYA provides  standard documents  for the sale/purchase and listing of boats
  • ABYA members hold  Professional Indemnity  and  Public Liability Insurance
  • ABYA members work to the  ABYA Code of Practice
  • ABYA operates a  Customs Warehousing Scheme  allowing brokers to offer ex-VAT boats for sale in the UK and overseas
  • ABYA members can advise on British Registration

Help with purchasing If you are buying, perhaps privately, and want a broker to deal with the paperwork for you to ensure you have all the right title documentation, many of them will offer this as a consultancy service for a negotiated fee.

ABYA Members are industry professionals and will provide advice and assistance with:

  • The type of boat that is best for you
  • Negotiation following the survey findings

ABYA Academy & British Marine: Practical Yacht Brokers Course

This two-day Practical Yacht Brokers  course is aimed at Yacht Brokers who have a degree of industry experience at listing and selling boats.

In-depth discussions will take place on the subjects of marine Law,  Anti-Money Laundering and KYC, Insurance, VAT and RCD; making sure attendees can demonstrate the knowledge and application of the necessary legal, financial and tax documentation required to pass on a good legal title when brokering a vessel.

  • How to use social media and digital marketing to maximise sales
  • Details on selling new, used and part exchange vessels and the different financing options available to clients
  • Tricky negotiations towards the end of a sale
  • Sea trials and the IPV Code
  • The role the Marine Surveyor plays in the brokering process, including MCA coding and the selling of commercial vessels.

There will be a Q&A session with an experienced broker. This industry expert will be available to share their decades of experience and answer any burning questions.

Report Writing is a key feature of a surveyor's training.

These four-part interactive webinars are open to any Member or Non-Member wishing to improve their surveying and report writing skills. The course has been formatted based upon old-school surveying practice and methodology.

ABYA “Introduction to brokerage”

Charlie North is a new Yacht Broker here at Parkstone Bay Yachts, as with all our brokers not only do they benefit from our in-house training but also the superb training offered by ABYA (The Association of Brokers & Yacht Agents). Below are a few words from Charlie about the course he successfully completed last week.

“Last week I was able to attend the ABYA (The Association of Brokers & Yacht Agents) ‘Introduction to Brokerage Course’ hosted at the Marwell Hotel. Held over two days the course is an intensive but informative set of talks from various Marine Industry bodies such as law firms, insurance companies, experienced brokers and HMRC. ABYA offers the course, along with its membership system to both experienced and new yacht brokers (like me). Through completing the course and meeting the set requirements for experience and conduct, yacht brokers are able to become ABYA members. ABYA has over 200 members based both in the UK and abroad and by using and promoting the ABYA logo and code of conduct it gives both vendors and buyers the confidence and trust that the sale or purchase of their boat will be done safely and legally. ABYA also provides advice and training to ensure their members are always supported and up to date on the latest legislation. During the course we were able to learn about the legal and tax aspects of yacht brokerage as well as being taken through the full brokerage process from experienced brokers and industry leaders. Advertising yachts in todays market is dominated by the internet and we were lucky enough to be taken through the key factors in a successful online presence by Nick Crang from  Yachtworld.com .  Between the aforementioned talks on insurance, law, tax and advertising our course leader took us step by step through his daily roles and responsibilities. As well as giving us first hand accounts of successful sales but also how to overcome the hurdles that can arise during a yacht sale.”

The Association of Brokers and Yacht Agents (ABYA) is an association that represents professional yacht brokers, dealers and also new boat salespeople. ABYA members must have demonstrated knowledge and application of the necessary legal, financial and tax documentation required to pass on a good legal title when buying a vessel to become a member.

ABYA provides ongoing training and monitors the continual professional development of its members to ensure that they are up to date on key areas such as marketing, anti-money laundering, the Recreational Craft Directive, Sale of Goods Acts, contract law, health and safety and the VAT Status of vessels.

Your ABYA Broker will provide a turnkey solution to help you sell your boat or help you find your ideal boat that matches your requirements as close as possible to your requirements.

ABYA has almost 200 members in the UK and abroad and they variously specialise in new and second-hand boats from day boats to large yachts and also commercial craft such as workboats and RIBs.

Many have attended the ABYA Professional Yacht Brokerage course and members keep their knowledge up to date by undertaking Continuous Professional Development (CPD).

They say that it will take about 100,000 articles to cover the full scope that they have envisioned for the website. They have over 20,000 articles so far and that's doing pretty well, but it could take several years to get the rest. I also noticed that many of the Main Topic Pages and some of the article pages are still in the rough draft stage. I guess that they will fill in as they can get volunteers to work on them. The website is growing in content every day. They even had to move to a bigger, more powerful server because the website's traffic has been growing exponentially. "

More courses lined up for 2024 – a must attend for those looking for the next step in their yacht broker journey

Organisers, speakers, and attendees have heralded the first ever ABYA Academy and British Marine delivery of a new Practical Yacht Brokers training course a great success.

Aimed at Yacht Brokers with a degree of industry experience at listing and selling boats, the sell-out two-day course, which took place on 9-10 November, saw twenty-four delegates come together to take a deep dive into the world of the yacht broker. 

Attendees took part in in-depth discussions on the subjects of Marine Law, Insurance, Anti-Money Laundering and Know Your Customer (KYC), VAT and Recreational Craft Directive (RCD); alongside exciting new topics including selling techniques, conflict management, and how to use social media and digital marketing to maximise sales to help give them that competitive edge.

Course participant Richard Roberts from The Yacht Market commented: “If you have a brokerage yourself, this is an essential course to go on.  ABYA and British Marine running this course together, has been fantastic. The professionalism has been wonderful and I’ve learnt so much.  I can now go back and help my clients even more.  I would wholeheartedly recommend this course.”

“With the brokerage industry undergoing fresh challenges, a joint training programme championed by ABYA and the BRBA has long been on our agenda. Given this, it was very exciting to be able to help deliver the first sell-out course in Southampton last week. New modules relating to AI, conflict management and the status of client accounts have been added to old favourites, all of which will ensure that professional brokerage houses can maintain the level required to set them above the others. We have got brokers signed up for the next event in March already!”, commented Alastair Walton.

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Geller is a partner at Robbins Geller Rudman & Dowd LLP, which specializes in securities litigation on behalf of investors. The firm has offices in 10 cities, including Boca Raton.
