Here's How the Yacht in the Overboard Remake Compares to Goldie Hawn's Original

The film Overboard is about the haves and the have-nots—or, in this case, the haves and the have-yachts. The original 1987 film, which stars Goldie Hawn and Kurt Russell , and the 2018 remake of the same name—which stars Eugenio Derbez and Anna Faris and was released just this month—feature childish yacht owners (Hawn and Derbez, respectively) who have amnesia and are, then, reestablished in less elite but comedic existences. For each of the Overboard films, ultra-luxe boats weren't only a crucial part of the setting—they were also key in demonstrating the characters’ status, and characters’ dedication to status symbols.

In Overboard (1987), the 130-foot Yecats from Kong & Halvorsen in Glenorie, Australia (which was renamed the Attessa in 1992 and the Huntress in 1998), was featured as the S.S. Immaculata. (The same boat was also featured in 1993's Indecent Proposal, which stars Woody Harrelson and Demi Moore.) The interior decoration was characteristic of the era: The bold colors and excessive design complemented Hawn's character's profligate outfits. Brent Thomas, the production designer for Overboard (2018), describes: “There was definitely a campy vibe to it and it was incredibly ’80s, both in palette and in shapes and tones. It worked very well, but it was gauche and over the top and it assaulted your senses a little bit. We wanted to make our yacht in the remake a little more sophisticated and elegant and cleaner and crisper and more pristine and grounded, perhaps. A sort of sleek, smooth, gentleman’s fantasy but with elegance and taste as opposed to the one in the original.”

Thomas and his team chose the 164-foot Aspen Alternative for Derbez’s Birthday Present —a 2010 custom creation from Trinity Yachts in Gulfport, Mississippi, that he sourced from Saint Maarten in the Caribbean after a lengthy international search. (In case anyone gets a case of yacht envy, the Aspen Alternative is currently on the market for $18.9 million.) Thomas credits the boat’s aesthetic—its “old-world elegance” with exotic sapele-wood details—as the reason for the decision.

The Aspen Alternative’s exteriors and main salon were featured in the film, but the interiors were constructed in Vancouver, Canada. In Overboard (1987), there’s a focus on the estate room’s closets, with Hawn exclaiming at one point, “Well, the entire civilized world knows that all closets are made of cedar!” (Cedar can be more costly and is often considered more prestigious, as it repels moths and moisture.) For this reason, Thomas says he introduced one in the remake, too: “As a little shout-out to Goldie’s closet, I gave Eugenio a fabulous walk-in closet. It looked like a Hugo Boss store with shelves of shirts and shoes. It was lit and beautifully laid out. Again, as a wink and a nod, we gave him a place for a bunch of shoes as well.”

Shelley Holmes wondered who owns the luxurious navy blue and white mystery yacht anchored out in San Diego’s harbor north of the Maritime Museum.

It’s the 332-foot Attessa IV, belonging to industrialist billionaire Dennis Washington .

He’s the Montana-based founder of the Washington Companies and a long-time San Diego visitor. His $150 million yacht, described as “one of the most exquisite” by Forbes.com, has been a frequent sight at the Kona Kai Marina on Shelter Island.

On June 4, however, the yacht was all decked out for a party. Washington’s invitees celebrated the 90th birthday of Bill McComas , a part-time resident of Rancho Santa Fe. McComas is one of the founders of IGT ( International Gaming Technologies), a firm dominating the poker video gaming machine market.

In the interest of trivial pursuit, Washington’s predecessor Attessa yacht, although it bore a different name, was used the 1987 film “Overboard” starring Goldie Hawn and Kurt Russell . That Attessa also appeared in the 1993 movie “Indecent Proposal” with Robert Redford and Demi Moore.

Helping hand: Sharon LeeMaster , the voice for numerous local not-for-profit organizations, fell and broke her wrist the other evening. Despite her pain, she kept an appointment the following morning to deliver donated Padres ballgame tickets to the San Diego Madres for its fundraiser.

While there, a kindly member of the Madres volunteered to help her while she is on the mend. “Could I come by and read to you, or do whatever you need?” queried Dorothy Yonimitsu .

The age of the lady so generously offering her services? 98.

Busy as a bell: The local Spirit of Liberty Foundation’s America’s Freedom Bell traveled to the World War II monument in Washington, D.C., for Memorial Day. Secretary of Defense Ash Carter rang the huge bronze bell, which resembles the Liberty Bell, as did thousands of other attendees.

After the ceremony, the bell rode on a float in the Memorial Day parade then was bundled up and flown to France for the international observance of D-Day in Normandy on June 5 and 6.

The bell was originally cast on June 6, 2013. It bears the symbols of all the branches of the Armed Forces and contains metal from the Twin Towers destroyed in the 9/11 terrorist attack.

Good sports: Soccer player Kraig Chiles was honored as San Diego’s 2016 “Sports Man of the Year” at the Hall of Champions in Balboa Park. Stealing some of the San Diego Sockers star’s spotlight, however, was his “date” at the Taste 4 Sports event — Chiles’ 2-year-old daughter.

Perennial attendee Bill Walton was unable to be at the celebration this year but his presence was felt nonetheless — a dinner with the hoops star was auctioned for more than $400.

From the archives: Inside Attessa IV's 2010 rebuild

In this 2012 deep dive, Marilyn Mower takes a look at the enormous rebuild of the 101.2-metre Attessa IV , which is now on the market asking  €149,500,000... 

People who don’t know Dennis Washington wonder why he rebuilds yachts instead of building new custom ones. For Washington, who made his mark in heavy industry, a good hull is his version of a clean sheet of paper; on it he builds his dream along the principles of what he perceives as the best of Dutch boat building. Redoing yachts is his passion, pleasure and relaxation.

His projects combine the talents of Seattle-based designer Glade Johnson , Washington’s wife Phyllis, and his captain Ted McCumber, who joined the band as captain of the first Attessa .

Yacht broker Merle Wood set this particular rebuild of  Attessa IV in motion in the spring of 2007, by telling him that Chang Yung-fa, chairman of the Taiwanese Evergreen Group was ready to sell his 91-metre yacht Evergreen . Chang had the yacht designed by Diana and built at a commercial yard in Japan. It was a conservative yacht for a different type of cruising and culture, but Wood saw it had something in common with all the previous Attessas – good bones and a challenge. A month later Evergreen steamed into Vancouver via Hawaii.

Vancouver Shipyards has a corner devoted to Washington Yachting Group. It was here that a 30 x 90 metre floating shipyard was constructed on a barge, while engineering drawings were being made for Evergreen ’s revival. Diana was retained to survey the hull and condition of the systems against the original documentation, while Gregory K. Marshall was hired as the naval architect for the new decks and superstructure.

Washington’s concept for  Attessa IV  was ambitious: new bow, new stern, new foredeck tender garage , new spa, new superstructure shape, all new helipad, and totally new interior layout, including crew areas. The yacht originally had a large karaoke bar, 15 owner and guest cabins and room for 21 crew in rather packed conditions.

The main deck and above were gutted to the shell, the mains and generators overhauled, virtually every bolt and wire was replaced, engines re-bedded, fuel tanks moved, flume tanks removed and the space stripped, soundproofed and painted. That and reconfiguring the crew areas, extending and widening the bow section, adding the folding mast, a forward tender garage with gull-wing doors, bulwarks that slide down and aft simultaneously to allow the large tenders — an 11.5-metre Novurania Chase and a 10-metre Riva — to be launched over the side, and the huge aluminium stern door that disappears completely from view down and under the aft deck sole.

Washington, as noted, liked the yacht’s size and overall structure, but thought it looked entirely too commercial, like a cruise ship. The puzzle he worked on was how to keep such a large vessel intimate, both inside and out. To control the vastness of the space, he envisioned  Attessa IV  having a waist at the area of the central ventilation and exhaust trunks amidships, and flares to widen the side decks fore and aft.

Indeed, the space is a vast canvas with 2,322.5 square metres of interior, including 1,672.25 square metres in owner and guest areas. From day one,  Attessa IV  was going to have a grand entrance area and stunning central circulation. The stairs, spiralling through five decks, are split into pairs of semi-circles divided by a fore and aft passageway, making a landing and foyer at each deck.

The show-stopper on  Attessa IV , however, is on the deck above main, called the guest deck, where this lobby becomes an athwartships passage, as well as offering access to the walk-around side decks and side terraces. If the view itself, through the floor-to-ceiling windows and doors port and starboard, isn’t arresting enough, this lobby features three Botero sculptures.

Attessa IV' s side terraces incorporate what Washington calls ‘flare-outs’, a series of graceful curves on each deck to eliminate the slab-sidedness of the original profile and remedy the straight deck sightlines.

There are four large, elegantly decorated guest suites on the guest deck and with the dining room/library forward and a saloon aft, followed by an alfresco dining space and sun pads, it is a deck with enough varied spaces and activities for an entire day. The forward dining saloon is worthy of particular note, as it is one of the cosiest spots aboard.

The master suite aboard  Attessa IV  is one deck above. Here the stair column on port is the backdrop for Washington’s desk, which is adjacent to large windows. There are entrances port and starboard to the master stateroom, which is an homage to the glamour of Hollywood in the 1930s.

The fireplace is an ultra romantic 19th-century English piece with statuary marble. A large bath and dressing area separates the stateroom from its sitting room, which features sapele joinery, leather chairs and another fireplace, this one a 19th-century French, Louis XV-style in verde marble. The colour scheme of the sitting room is primarily green as a bridge to their private aft deck lounge was done in navy blue and green tones.

Originally, the deck above was going to be a sundeck, then the Washingtons’ son bought a Chihuly chandelier at a charity fundraiser. It is a famous piece, more than 2.2 metres tall, and was part of a Chihuly exhibition in Venice in 1996. Searching for a way to incorporate the piece in  Attessa IV , Washington and Johnson hit upon the idea of enclosing the sundeck with a composite superstructure and bumping up the centre with a dome five metres above floor level. The space and the piece seem made for each other and in fact this multi-function room, called the Chihuly Lounge, is one of Washington’s favourite spaces in the yacht.

Another favourite is the spa on the lower deck of  Attessa IV , where numerous treatment rooms and a sauna lead to a gym and out onto the swim platform. Just forward of the spa are two more guest suites with king-size beds, and a pair of twin cabins Phyllis decorated for her grandchildren. And then there is the main deck cinema with its 3D capability and lighthearted adjacent lounge and bar.

Attessa IV is now for sale with Merle Wood.

Yacht in overboard and indecent proposal - the huntress I believe the yacht was called The Huntress at one time in the late 90's. I was on board it for a few months although the interior shots were not the same yacht as in the movie, as well as the movie Indecent Proposal. It was a Fead Ship. I also heard that it did burn in the Med. Not sure if it still exists but could have been retrofitted and renamed. I was in the engine room they showed in the Movie Overboard as well as the galley. The engine room was exactly the same but the galley had been retrofitted with green marble countertops. I attached the pic of the ship I knew as The Huntress. It was owned by a greek billionaire - who was called "Mr. A" affectionaly by his crew. I dated the English Engineer, Joe O'Donnell for a bit. I had the good fortune of spending a weekend on board as a guest in La Paz in April 1997. At the time, it had tons of green marble as countertops in the galley and the luxirious bathrooms/staterooms. We had a wall of bubbles from the jacuzzi because the engineer accidentally used dish soap so the wall OF BUBBLES was about 20 feet high! It had it's own whaler and it had at least two jet skis.

It turns out that I was incorrect and the Huntress was not the yacht used in the movie Overboard. but she was a beautiful ship nonetheless.

I was just wondering the same thing myself. A fun little film. It looks like they shot the interiors onboard the yacht itself rather than build a stage. It was probably done to cut down production costs. It's funny though, I wonder if there was more than one boat used in that film, because she does seem to have different lines in a couple of scenes. Yecats Hello, I just returned from Silverwood Theme park in Northern Idaho. While there I was overcome with what would posses a person to put a theme park up in the middle of the northwest? At the end of our trip before closing I saw and purchased the book I finished today. American theme park: the creation of Silverwood By: Gary Norton Apparently Mr. Norton founded ISC in Spokane WA, in the early 70's (they made teller terminals for savings and loans.) After his IPO he had "Yecats" built by Kong and Halverson. "Yecats" is "Stacey" for his wife it the time. They would build the ship if he put everything in it motors etc. The story of the helipad and the rest is a very interesting read, however only if you are into these sorts of things. The movie overboard: Yecats was sold to fund something else in his life, the movie was filmed on transport after the sale from WA, to CA. The new owner was going to completely redo the interior, So the film crew was free to do as they pleased. Hope this helps, I navigated here hoping to find some pic's of the boat from the book. If the Attessa was renamed Huntress than I can tell you exactly what happened to her. In late spring of 1994 I was deployed to the Med. with a carrier out of Mayport when we received a distress call stating a yacht was on fire. We sent a rapid response team to rescue the remaining crew and passengers; by the time our team got there it was already out of control and, unfortunatetly, sank with a bunch of our damage control equipment. I still have the article somewhere. The irony and interlinked coincidence of this was my ship was the USS Saratoga, the same one Capt. Ron (Kurt Russell) helmed.

Yecats, Gary Norton. I guess the best person to ask would be the purchaser. He own/runs Silverwood Theme Park in Northern Idaho. From what I read in the book, (lots of cool, boat, heli., plane, stories) If you where 20-40 in the 70'80's man they had some cool stuff back then. (less laws as well) He sold the boat and moved on, nothing else said other then what they did on reroute down to (sandiego)?? I looked for more about Yecats, and it brought me here. At least I've been able to help clear up part of the mystery. -Cap
This is the original vessel with the agreed modifications between Gary Norton and Kong & Halvorsen. He picked it up from them, but again (one of the greatest regrets he has is not sailing it back to the states) in the book. He had other issues to deal with and missed out on the trip.

Correction to my previous posts http://www.***************.com/yachts/details/5139/ that's "super yachts - no space " blocked with the ************* I am unable to delete incorrect pics of the Huntress that was retro-fitted in San Diego South Bay in 1997-1998. After a trip to Mexico, then to Alaska, the boat went over to The Med, where it burned in 1998.

Reviving a footnote in history

The year was 1853, and the steamboat Jenny Lind departed Alviso at the southern tip of San Francisco Bay for its standard voyage to the city.

Then disaster struck.

A boiler pipe failed, and pressurized steam blew out the furnace doors as passengers awaited their lunch. At least 32 died slow and gruesome deaths from burns, among them some of the Santa Clara Valley’s most prominent residents. Others are believed to have jumped overboard and perished.

For Bay Area residents, the disaster has been little more than a historical footnote, a nod to the era of steamboat travel.

That changed Saturday, when more than 300 people gathered at a county park of wetlands for the unveiling of a monument that commemorates the dead and raises new questions about how their untimely passing might have altered the course of California history.

“One hundred and sixty years and two days after the fact, you came to see the drape being lifted and something wonderful come out of a tragedy,” Claire Britton-Warren, the impetus behind the endeavor, told those gathered.

Crops, goods and travelers all passed in and out of San Jose through the thriving port of Alviso. But it, too, died a slow death not long after the accident when the railway came along. Annexed by San Jose in 1968, it remains largely untouched by Silicon Valley’s economic prowess. Santa Clara County Supervisor Dave Cortese, who has pressed for development here, said the nod to its history could contribute to a comeback.

“I’m not going to stop until we get Alviso back to the glory days of the Jenny Lind,” he said from a lectern with the bay as his backdrop.

So why now? That is the story of the self-named Jenny Lind Gang.

Leading the crew is Britton-Warren, a technical writer and genealogy buff who reenacts train robberies and has been known to dress like a pirate. Now 50, she had worked hard to fill out her family tree. But there was a bare branch. She knew her great-great-great-grandfather, John S. Bradbury, had died at age 29, but how and where the man from Guilford, N.Y., had perished was a mystery.

Then, three years ago, a message for Britton-Warren popped up on Ancestry.com from a historian in Guilford who had the answers. The family hadn’t even known Bradbury had come to California -- he was here three weeks. But when the dates checked out, Britton-Warren began her obsessive research, soon compiling a stack of documents as thick as a phone book.

She then turned to the local historical societies for help: “I just kind of showed up on their doorstep with my arms loaded ... and said, ‘look what I found.’ ”

They connected her with Russ Robinson, the 77-year-old staff commodore and historian for Alviso’s South Bay Yacht Club -- founded just 35 years after the steamboat accident -- and Chris McKay, 60, historian for the local chapter of E. Clampus Vitus, a fraternal organization that rose to prominence in the Gold Rush days caring for widows and children of miners.

Revived in the 1930s, the fun-loving group that mocks self-serious Masons and Oddfellows has carved its niche as a historical (and drinking) society, helping to place 78 plaques in Santa Clara County alone. Clampers were out in force Saturday as volunteers in trademark red shirts and flamboyant trappings (top hats and skunk pelts). McKay’s hat sprouted peacock feathers.

The society is among eight historical organizations that donated to the monument, which boasts a local artist’s rendering of the Jenny Lind, a side-wheel steamboat about 65 feet in length named after an opera singer revered as “The Swedish Nightingale.”

As their research of the disaster advanced, the trio found many inaccuracies in local press accounts. But they came across one helpful piece in a Midwestern newspaper. Since it probably took eight weeks for the reporter’s work to arrive back home via steamboats and mule, he took his time and got it right, Robinson said.

The article revealed that another vessel, the Union, was at the mouth of Alameda Creek when it spotted the Jenny Lind in distress and went to its aid. That helped place the accident between today’s Dumbarton Bridge and San Mateo-Hayward Bridge.

Robinson also caught a break at San Francisco’s Mission Dolores when an archivist shared records of a French family, the Baudichons, who all died in the accident.

In addition to families with small children, also lost were local power brokers. Among them were Jacob D. Hoppe, developer of Alviso and delegate to the California Constitutional Convention, who was lobbying to return the state capital to San Jose, and Charles White, the first alcalde -- or mayor -- of Pueblo de San Jose, who was also a wealthy landowner pressing the same case.

“What we can say for sure is that the Jenny Lind wiped out some of the major supporters of this effort,” said Britton-Warren. “It’s hard to say what might have happened if they hadn’t all been killed.”

Perhaps, she suggests, the prominent group was headed to a secret engagement to lobby for their city? As it happened, Sacramento was chosen at the convention in Benicia just days after the accident.

Paul Bernal, president of the California Pioneers of Santa Clara County, which contributed to the monument, is skeptical of that theory, noting that other delegates pushing for San Jose were neither on board nor traveling that day.

Still, he called the amateur gang’s research on the Jenny Lind “the best to date.”

The group plans to place a copy of its white paper in San Jose State’s California room.

Britton-Warren is grateful the disaster can “take its proper place in history.” But beyond that is a sense of peace that her ancestor’s suffering -- Bradbury survived four hours -- has been honored.

“What really got me started was feeling like someone had to understand exactly what he had been through, said Britton-Warren, who on Saturday wore a dress modeled after one in a photo of Bradbury’s young wife. “It was up to me.”

The Palm Beach International Boat Show — the yacht world's flashiest event stateside — is returning this year with over 800 boats for both deep-pocketed potential owners and window shoppers to peruse.

While it's impossible to know what exactly will be on display until the show begins on Thursday, it's expected that eight megayachts — generally defined as ships over 60 meters long — will be docked at the show and at nearby marinas like the Rybovich Marina in the ritzy Florida town.

Some of these are for sale at eye-popping prices, but others are available to charter in case you fancy living like a billionaire for a week or two this summer (and if you have six figures to spare on a vacation).

These are the eight biggest yachts that will be at the Palm Beach International Boat Show and nearby marinas, in size order.

Nero: 90.1 meters

Price: From $497,000 a week (charter) Standout features: Pizza ovens, beauty salon, massage room, resistance pool

Reportedly owned by Irish billionaire Denis O'Brien, Nero is modeled after J.P. Morgan's 1930s ship , and was built in 2007 and updated in 2021.

She now boasts a gym on her sundeck with multiple cardio machines and a beauty salon, and has an on-board beautician for manicure, pedicure, hair, and massage needs. There's also an upgraded movie theater, two new pizza ovens, and both a pool and a jacuzzi.

For those who want to go overboard, she has more than a dozen toys, including a waterslide, Jet Ski, and flyboard.

Victorious: 85 meters

Price: From $876,600 a week in the summer and $950,000 a week in the winter Standout features: Hammam (Turkish bath), wine cellar, wood-burning fireplace, children's playroom

Victorious brings a party vibe to the yacht show. With a beach club on board, a wine cellar, a cigar clubroom , multiple bars, and a lounge with a piano, the vessel is made for entertaining. Plus, there's a playroom and movie theater to entertain the kids.

For tamer charter clients, Victorious has a suite of wellness features such as a gym, massage room, beauty salon and hammam — perhaps a custom request of her owner, Turkish businessman Vural Ak.

She also boasts a treasure trove of water toys, including Jet Skis, jetsurfs, inflatable kayaks, and scuba equipment.

Casino Royale: 72 meters

Price: TBD Special Features: Infinity pool, helipad, private jacuzzi

Purchased and refitted by car dealer magnate John Staluppi last year, Casino Royale is the latest of his James Bond-inspired yachts (he's also owned an Octopussy and a Skyfall, among others).

Casino Royale has a helipad that turns into a dancefloor, an infinity pool, and a wellness center with a gym and sauna. The owner's cabin has its own deck, which features a private bar and jacuzzi.

However, the boat's price isn't listed, and while she's not necessarily officially for sale, that might change depending on who's prepared to buy, Mr. Bond.

Talisman C: 70.6 meters

Price: $60 million (or from $567,000 a week to charter) Special features: Massage and beauty room, private library

Likely the largest yacht for sale (not just charter) at the show, the Talisman C is a 2011 six-bedroom boat. The owner's cabin comes with an en suite bathroom, dressing room, private library, and crystal chandeliers.

Amenities include a gym, a beauty room, oversized jacuzzi, and a fully equipped bar. Her crew of 19 includes a trained masseuse, and the toy room comes equipped with a wakeboard, eFoil , and WaveRunners.

Joy: 70 meters

Price: From $650,000 a week Special features: Disco club, basketball court, onboard fitness instructor

Superyacht Joy testifies to the fact that owners want as many on-board experiences as they can get.

There's an expansive suite of fitness features, including a basketball court (don't shoot that hoop too hard!), a personal trainer on staff, boxing equipment, and a handful of machines. For post-workout winddowns, there's a spa with a steam room and onboard masseuse. And for entertainment, there's both an outdoor and indoor cinema, and a disco club.

Triumph: 65.4 meters

Price: From $707,600 a week in the summer and $650,000 a week in the winter Special features: Sauna, helipad, banana boat

This 2021 superyacht is named after Triumph motorcycles — a reported favorite of her rumored owner, British businessman Chris Dawson — and even has one on display as an art piece in the upper deck's lounge. The primary suite is 1,400 square feet and has its own study , and there's a sauna, an indoor-outdoor gym, a helipad, and a massage room spread among her six decks.

She boasts an "armada of water toys," including two kinds of Jet Skis, electric water bikes, and a banana boat.

Seanna: 64.5 meters

Price: $54,000,000 (or from $462,000 a week to charter) Special features: marble foyer, movie room, sundeck pool

The recently refurbished Seanna is available for sale and charter.

Her indoor-outdoor gym is on sea level so that passengers can take a dip after a session with the onboard personal trainer. There's also a sundeck pool, a helipad, a two-room massage facility, and, for the more cerebral guests, a library with an electric fireplace.

There are a number of toys on board, including a popular water trampoline and two WaveRunners.

Come Together: 60 meters

Price: $65,000,000 Special Features: DJ and videographer on board, ice bath, sauna

Next-to-new yacht Come Together is looking for a new owner after doing charters during the 2023 season.

The Beatles' influence is evident beyond the yacht's name, with guitars dotting the sky lounge and a crewmember who doubles as a DJ. There's also an outdoor cinema and bar for entertainment and an ice bath and sauna for the day after the party. The owner's suite has a private study and lounge, and each guest cabin has its own ensuite.

The sale includes a number of toys, like Jet Skis, kayaks, and Seabobs.

Four years after fire engulfed a California dive boat, killing 34, the captain’s trial begins

LOS ANGELES — By the time the scuba dive boat sank off the Southern California coast after catching fire,  34 people had been killed  in the deadliest maritime disaster in recent U.S. history.

The Labor Day tragedy in 2019 spurred changes to maritime regulations, congressional reform and civil lawsuits. Four years later, a federal trial for the Conception’s captain, Jerry Boylan, was underway Tuesday with jury selection in federal court in Los Angeles. Boylan watched as the judge questioned potential jurors.

It’s been a long, frustrating wait for the families of the dead.

“The past four years have been like living in a nightmare that you don’t wake up from,” said Kathleen McIlvain, whose 44-year-old son Charles was killed.

The 75-foot boat was anchored off the Channel Islands, 25 miles south of Santa Barbara, on Sept. 2, 2019, when it caught fire before dawn on the final day of a three-day excursion, sinking less than 100 feet from shore.

The National Transportation Safety Board blamed Boylan for the tragedy, saying his failure to post a roving night watchman allowed the fire to quickly spread undetected, trapping the 33 passengers and one crew member below.

Those on board included a new deckhand who’d landed her dream job and an environmental scientist who did research in Antarctica, along with a globe-trotting couple and a Singaporean data scientist.

Susana Solano Rosas lost her three daughters Angela, Evan and Nicole Quitasol, who were onboard the Conception with their father, Michael Quitasol, and his wife, Fernisa Sison. Solano Rosas waited with other relatives for jurors to be chosen.

“We’ve been waiting for this for a long time,” she said. “We want to start some healing.”

U.S. District Judge George Wu on Oct. 12 granted Boylan’s request to bar most if not all references to “victims” — which the captain’s attorneys say is a prejudicial term that jeopardizes his right to a fair trial. It was the latest setback for the prosecution.

A grand jury in 2020 initially indicted Boylan on 34 counts of a pre-Civil War statute colloquially known as “seaman’s manslaughter” that was designed to hold steamboat captains and crew responsible for maritime disasters. Each count carries up to 10 years in prison in a conviction, for a total of 340 years.

Defense lawyers sought to dismiss those charges, arguing the deaths were the result of a single incident and not separate crimes. Prosecutors got a superseding indictment charging Boylan with only one count.

Then in 2022, Wu ruled the superseding indictment failed to specify that Boylan acted with gross negligence, calling that a required element to prove the crime of seaman’s manslaughter. He dismissed that indictment, forcing prosecutors to go before a grand jury again.

Boylan is now charged with one count of misconduct or neglect of ship officer. The single count means he faces only 10 years behind bars if convicted.

He has pleaded not guilty and denied any wrongdoing. His federal public defenders did not return The Associated Press’ repeated requests for comment, and a spokesperson for the U.S. Attorney’s Office declined to comment.

Some of the dead were wearing shoes, prompting investigators to believe they were awake and trying to escape. Both exits from the below-deck bunkroom were blocked by flames.  Coroner’s reports list smoke inhalation as the cause of death.

What exactly started the fire remains unknown. Early official scrutiny appeared to focus on a spot where divers plugged in phones and other electronics. But a  Los Angeles Times story , citing a confidential report by the Bureau of Alcohol, Tobacco, Firearms and Explosives, said the blaze began in a plastic trash can on the main deck. An official cause remains undetermined.

Boylan and four crew members sleeping in the upper deck told investigators they tried to save the others but were ultimately forced to jump overboard to survive. Boylan made a mayday call before abandoning ship.

Dozens of family members have since formed “Advocacy34” to push for strengthened boating regulations. While seeking answers, they’ve comforted each other during loved ones’ missed birthdays and mourned each anniversary.

“We have no idea when we’ll get those answers, or if we ever will,” McIlvain said.

The NTSB faulted the Coast Guard for not enforcing that requirement and recommended it develop a program to ensure boats with overnight passengers have a watchman.

Victims’ families have sued the Coast Guard in one of several ongoing civil suits.

At the time of the fire, no owner, operator or charterer had been cited or fined for failure to post a roving patrol since 1991, Coast Guard records showed.

The Coast Guard has since enacted new, congressionally mandated regulations regarding fire detection systems, extinguishers, escape routes and other safety measures.

Three days after the inferno, Truth Aquatics Inc., which belongs to the Conception’s owners, Glen and Dana Fritzler, filed a lawsuit in U.S. District Court in Los Angeles under a pre-Civil War provision of maritime law that allows it to limit its liability to the remains of the boat, which was a total loss. The time-tested legal maneuver has been successfully employed by the owners of the Titanic and other vessels, and requires the Fritzlers show they were not at fault.

The couple’s attorneys did not respond to requests for comment.

In response to the families’ outcry, federal lawmakers last year updated the Limitation of Liability Act of 1851 so owners could be held liable for damages regardless of the boat’s value afterward. The law is not retroactive, however, and will not apply in the Conception fire.
