Costs & considerations of international yacht insurance

Owning a boat can add a whole new dimension to your lifestyle – dreary landlubber days are transformed into endless fun on the water, and priceless memories with family and friends. But regardless of the type of vessel you’ve chosen, it’s important to protect yourself and your investment by carefully weighing your yacht insurance options before hitting the high seas. 

Let’s face it, being out on the water can bring along with it situations that are not within our complete control. Other boaters, weather conditions, equipment failures and more can put even the most experienced captains in need of a marine insurance policy.

While the topic is extensive, and you’ll ultimately want to discuss your needs with a licensed insurance agent, this guide can help you understand some of the basic costs and considerations of international yacht insurance. 

Yacht insurance coverage

While some homeowner’s policy riders are adequate for small boats with limited horsepower (usually 25-50hp), this option normally provides coverage only for usage in inland waterways, lakes and rivers. So if you have a larger vessel, like a yacht, large sailboat or jet ski, or if you plan to use your boat beyond the intracoastal waterways, you’ll likely want to explore coverage through a reputable marine insurer. 

Damage to your vessel (by natural disaster, collision, theft or vandalism), personal injury (if someone gets injured on your boat), equipment loss and property liability (if you damage someone else’s property with you boat) are things typically covered by marine insurance, depending on your policy.

Additional coverage is usually available for things like medical payments, personal effects or uninsured boater’s liability, which will affect your yacht insurance cost. Many policies will include coverage for permanently attached equipment, and items like anchors, trolling motors and seat cushions, but be sure to discuss these details with your agent. 

Yacht insurance add-ons

Depending on how much you’re willing to spend, further coverage add-ons can be available to cover more specialized circumstances. Yacht owners sometimes want coverage for a specific item on their boat that’s especially valuable, like expensive navigation equipment. 

Owners of large yachts sometimes add salvage coverage that pays to remove a boat that’s been damaged or disabled. Salvage can be very expensive, with some operators taking a percentage of the vessel’s value as payment. 

Towing coverage is becoming a popular option for many boaters, particularly for those that venture further off shore – where towing costs in case of a breakdown can easily run in the thousands of dollars.

International yacht insurance

Boat owners that plan to cruise outside of the USA should consider purchasing an international extension that expands the policy to foreign countries. Risks are often magnified when embarking on long excursions across borders, where even relatively minor mechanical breakdowns can result in substantial repair expenses.

Yacht insurance cost factors

Of course, the cost of yacht insurance varies greatly depending on a number of factors, including the size, value and horsepower of the vessel that’s being insured, as well as the amount of coverage desired. As with car insurance, higher liability limits cost more, and higher deductibles will lower the premium.

So, if you’re asking yourself: how much is yacht insurance? Then bear in mind that some other things that affect cost include: 

  • The cruising area : Some areas will have a higher risk of damage to your boat due to weather or navigation challenges. If you use your boat only in fresh water, it generally costs less than salt water usage. And salt water, or larger areas of operation, generally cost more – especially when crossing borders.
  • Driving record : A good driving record on land can help you secure a better boat insurance rate. 
  • Boating safety courses : Boating safety training or certifications can help you qualify for discounts. 
  • Amount of usage : More time out on the water generally results in higher insurance rates. But, if you have your boat in storage for part of the year, ask if you qualify for discounts. 

Finding a yacht insurance agency

Be sure to research the available yacht insurance companies before deciding on a policy. Check with your state’s insurance regulatory agency, and ask your boating friends if they have a carrier that they would recommend. A first-hand recommendation from someone that has had a good experience with their agency is a good start. 

It can also be helpful to request quotes from more than one carrier. And, be specific and itemize the coverage your seeking to avoid paying for a policy that is more extensive than you really need.

Yacht insurance: What every owner should know

Although most owners know the importance of a yacht or boat insurance policy, the terms and conditions can be challenging to fully comprehend. Ensuring your yacht is appropriately insured means being clear on what a policy covers and excludes. 

What is yacht insurance?

Normally, owners would want or require protection against the following:

  • Loss of, or damage to, their own property (i.e. the boat);
  • Liabilities to third parties

Therefore, a typical yacht insurance policy, such as Marsh YachtCover, will have two basic sections:

Section 1: Hull and Machinery (H&M)

This section covers loss or damage to the boat and its machinery — including the hull, engines, sails, personal property, and equipment necessary to operate the boat.

Marsh YachtCover typically uses an "All Risks" wording, which provides cover against all perils to which the yacht may be exposed, with the exception of some named exclusions.

The most common causes of loss include:

  • Perils of the sea (e.g. grounding, stranding, heavy weather damage, capsizing or sinking)
  • Contact and collisions (e.g. with other vessels or docks)
  • Fire and explosion
  • Accidental damage (e.g. during loading, discharging or moving stores, gear, equipment)
  • Theft or vandalism
  • Like all insurances, yacht insurance will only pay for a loss if the loss is “fortuitous” — meaning that the loss must be accidental in some sense and not certain to occur. Therefore, insurers exclude: Loss caused by inherent vice or ordinary wear and tear.
  • Loss caused by willful misconduct of the assured.

The number and type of exclusions differ from insurer to insurer. Check your full policy wording to ensure you have the coverage you require.

Tip : Check that your insurance policy extends to cover the yacht when stored on land, and whilst in transit on the road by trailer.

Section 2: Protection and Indemnity (P&I)

This section covers legal obligations to other parties — such as bodily injury, loss of life, pollution, or damage to a third-party property — while the boat is operating or under your ownership. Liabilities include:

  • Third-party property damage : including loss or damage to any other boat, harbour, or dock caused by your boat.
  • Wreck removal : the cost of raising, removing and destruction of the wreck if legally required.
  • Bodily injury : claims for loss of life, personal injury, and illness of guests onboard.
  • Pollution : including cost of clean-up, prevention measures, and third-party liabilities involving an accidental discharge.
  • Legal costs : including the cost of correspondents, lawyers, surveyors, and experts required to handle any claim or legal defence.

You can also extend your liability coverage to include watersports. 

Additional Coverage Features

Marsh YachtCover typically includes other coverage features that enhance your level of protection, such as:

  • Medical Payments Covers reasonable medical expenses for all on-board, boarding, or leaving the insured boat on a per person basis. This may include the cost of an ambulance, treatment, and hospital charges.
  • Emergency Assistance Pays for the costs incurred when emergency assistance is required, even if you and your yacht are not in immediate danger, such as towing a yacht stranded at sea.
  • Uninsured Boater Coverage Pays for bodily injury to persons aboard the yacht who are injured by an uninsured owner or operator of another yacht.
  • Bottom Inspection Pays for reasonable costs incurred for boat inspection after grounding, stranding, or striking a submerged object even if no damage is found, without application of any deductible. 
  • Marine Habitat Pays for damages that you are legally obliged to pay if you cause damage to marine habitat through physical contact with the yacht, such as dropping anchor onto a protected coral reef.

In addition, Marsh YachtCover offers optional cover depending on your needs and requirements:

  • Boat Show and Demonstration Coverage Covers the boat while exhibited during recognised boat shows, sea trials, and while the yacht is being navigated for demonstration purposes.
  • Personal Accident Coverage Unlike coverage under the P&I section, this is a no-fault product that can provide accidental death or permanent disablement benefits for insured persons, including the individual yacht owner, whether or not the accident is related to the yacht itself.
  • Crew Liability Liabilities to crew are excluded under typical yacht insurances. Therefore, if you employ crew you will need to purchase a standalone yacht liability insurance for a limit of up to US$500 million. This can also be extended to include Personal Accident Coverage for them, as described above.

Agreed Value Coverage

We pay the entire agreed amount, with no deductible, for a total loss. With our Masterpiece Yacht Select policy, eligible vessels can receive Replacement Cost coverage up to 120%.

Liability Protection

Limits of coverage to suit your personal needs, including: legal defense costs, liability as required by the Oil Pollution Act of 1990, wreck removal, and Jones Act coverage for paid crew.

Replacement Cost Loss Settlement

Repair or replacement of covered property is paid for without deduction for depreciation for most partial losses.

Uninsured/Underinsured Boater Coverage

Pays for bodily injury to persons aboard the insured watercraft who are injured by an uninsured owner or operator of another vessel.

Medical Payments

Reasonable medical and related expenses are included for all those onboard, boarding or leaving the covered vessel. These benefits are provided on a per person basis, rather than per occurrence. Optional and customized limits are available.

Search & Rescue

Up to $10,000 for the expenses incurred by an insured in relation to a governmental unit such as the United States Coast Guard (USCG) who provide emergency aid and assistance are included for no additional charge. With our Masterpiece Yacht Select option, coverage is available up to $25,000.

Longshore and Harbor Workers’ Compensation Act (LHWCA)

When Liability coverage is purchased, coverage is automatically provided for those employed aboard the vessel who are within the jurisdiction of the LHWCA.

Personal Property & Fishing Equipment Coverage

Protection is automatically included for the clothing, personal effects and fishing gear of the boat owner and their guests. Optional higher limits are available.

Coverage for Marinas as Additional Insured

Marinas, yacht clubs and similar facilities where clients keep their vessels are included as Additional Insureds.

Trailer Coverage

We automatically include coverage up to $5,000 for your trailer used with your insured vessel. Higher limits are available.

Emergency Towing & Assistance

Our policy includes this coverage with optional higher limits available.

We automatically provide this coverage, at no additional charge.

Precautionary Measures

We will pay up to the policy limit the reasonable costs incurred to haul, fuel or dock the insured watercraft endangered by a covered peril.

Bottom Inspection

We will cover the reasonable costs to inspect the bottom of an insured vessel after grounding, stranding, or striking a submerged object. There is no deductible for this coverage.

Oil Pollution Act of 1990 (OPA) Coverage

If Liability coverage is purchased, our policy provides coverage in addition to the Liability limit, up to the required OPA statutory limits, regardless of the Liability limit chosen. Additionally, if the OPA statutory limit is increased in the future, our policy will automatically increase the applicable OPA limit to match the new higher statutory limits.

Temporary Substitute Watercraft

Up to $5,000 to charter a temporary substitute watercraft if the insured vessel is out of commission due to a covered loss and cannot be repaired within 72 hours. With our Masterpiece Yacht Select policy offering, the limit of Temporary Substitute Watercraft is increased to $10,000.

Marine Environmental Damage Coverage

This feature provides protection up to $10,000 for fines and penalties as a result of marine environmental damage, as defined by the policy terms. Coverage is provided in addition to the insured's applicable Liability and OPA limits. With our Masterpiece Yacht Select policy offering, the limit of Marine Environmental Damage Coverage is increased to $25,000.

Masterpiece Yacht Preference

Masterpiece Yacht Preference fulfills the specialty insurance needs of luxury yacht owners with captained vessels 70 feet in length and greater, valued at $3 million or more.

No depreciation applies on the following items

Machinery inside the hull, Personal Property, dingy/tender, and Personal Watercraft.

Emergency Towing Service

We include coverage up to the amount of Property Damage with no deductible.

Benefits of yacht registration in Poland

Since April 2020 the Polish flag has become more and more popular with the foreign owners or operators of yachts and other vessels up to 24 m in length.

Low costs and lack of additional inspections for yachts with non-commercial use are interesting benefits for foreign users.

OBLIGATION TO REGISTER YACHTS

Under Polish law, yachts (both offshore and inland) with a length of more than 7,5 m or motor-driven boats with an engine power of more than 15 kW not exceeding 24 m (or vessels used for sailing outside the territory of the Republic of Poland) are subject to registration.

However, the following will not be subject to registration:

(1) vessels exclusively intended for regattas and sports competitions, having a rating class and a valid certificate issued by a Polish sporting association or a competent body in the flag state of the yacht, as well as rowing racing boats;

(2) vessels propelled exclusively by human power;

(3) surfboards, windsurf boards, or other similar craft.

The rule is that the  registration is obligatory for a ship that is Polish property, that is to say, a ship (by Polish law a yacht is also a ship) that:

  • is at least half-owned by a legal person established in Poland or a Polish national residing in Poland, if the operator of that vessel has their domicile or principal or branch establishment in Poland and the ship, at the request of all the joint owners, has been entered in the permanent registry ledger of the Polish registry of ships;
  • is owned by a corporate entity established abroad in which a legal person established in Poland or a Polish national residing in Poland holds participation if the operator of that ship is domiciled or has his principal or branch established in Poland and the ship, at the request of the owner, has been entered in the permanent registry ledger of the Polish registry of ships;

A ship owned by a citizen of an EU Member State or a legal person established in an EU Member State may also be entered in the Polish registry, with the reservation that the following ships are also considered to be such ships:

  • a ship that is at least half-owned by a legal person established in an EU Member State or an EU Member State national, if the operator of that ship has their domicile or principal or branch establishment in an EU Member State and the ship, at the request of all the joint owners, has been entered in the permanent registry ledger of the Polish registry of ships;
  • a ship that is owned by a corporate entity established abroad in which a legal person established in an EU Member State or an EU Member State national holds participation if the operator of that ship is domiciled or has his principal or branch establishment in an EU Member State and the ship, at the request of the owner, has been entered in the permanent registry ledger of the Polish registry of ships.

REGISTER AUTHORITIES

Polish law establishes two types of registration bodies authorities.

1)  the starost (or president of the cities)

2)  the relevant Polish sports association  (e.g. The Polish Yachting Association).

This means that a yacht used for sports or leisure purposes not exceeding 24 meters in length will be subject to registration with a sports association or a starost office.

This will also be a particular facilitation for foreign vessel operators or owners who have been allowed to register their craft under the Polish flag under the new law.

It is worth adding that a yacht exceeding 24 m in length, or one whose owner wants to use to establish a mortgage, will still be subject to registration with an admiralty court.

REGISTRATION FEES AND DEADLINES 

As of 1 August 2020, a new fee tariff for administrative procedures before yacht registration authorities will apply.

According to the Act on the registration of yachts and other vessels up to 24 m in length and its implementing acts, the fee for:

1) the registration and issue of the registration document,

2) an amendment to the registered data and the issue of the registration document,

3) the issue of a registration document duplicate

will be PLN 80 (approx. EUR 18).                             

4) the issue of a certified copy of or extract from the yachts registry will be PLN 15 (approx. EUR 3.36).

The registration authority shall record the vessel in the registry or decide not to register the vessel within 30 days. This period will run from the date of the submission of the complete application for registration.

Presently, anyone intending to register a yacht under the Polish flag has full discretion in choosing the registration authority. From 1 August 2020, a yacht can be registered with any county office or relevant sports association, with all the data finally ending up in a single registry.

However, the freedom to choose a registration authority is an important facilitation for owners and operators wishing to register their vessels under the Polish flag.

MAILING ADDRESS IN POLAND 

The new law certainly provides good perspectives for yacht owners and operators from both Poland and the EU.

It is therefore somewhat surprising that among the formal requirements to be met by applicants, the legislator should include a requirement for a mailing address in Poland.

The reason for this condition is not fully intelligible, since having to establish an address for service in Poland is bound to cause an unnecessary problem for foreign owners and operators.

One might expect the legislator to have used a more logical solution to this matter when constructing an Act of such significance to yachting and designed to strengthen the Polish flag.

RADIO LICENCES

It is worth reiterating here that operating a yacht under the Polish flag requires a license to operate radio equipment on that vessel. Consequently, the vessel’s owner or operator must apply to the Polish Office of Electronic Communications for a radio license.

Together with the radio license, the Office of Electronic Communications issues the vessel with a call sign and an MMSI (marine vessels) or ATIS (inland vessels) number required by international law for the safety of navigation.

When applying for a radio license, the natural person who owns the vessel is obliged to submit to the Office of Electronic Communications the relevant documents confirming his or her qualifications to operate the radio equipment on board the yacht that the authorization procedure applies to.

In the case of an applicant who is not a Polish national, the Office of Electronic Communications will only recognize qualifications awarded by the Royal Yachting Association, a British organization providing sailing training. The body issues competency certificates in English, which are among the most globally recognized.

The obligation to prove one’s qualifications does not apply to a legal person who owns the vessel and who is applying for a radio license for it, as it is believed that such a legal person shall not at the same time be the skipper/master of the vessel, as this post must be held by a natural person.

Until now, the registry accepted call signs awarded by the Office of Electronic Communications. However, such call signs could only be applied if the vessel was entered into the Polish registry.

Consequently, the owner or operator was forced to register their vessel without a call sign and then obtain the call sign from the Office of Electronic Communications. After these operations, the entry in the Polish registry of yachts could be supplemented with the newly awarded call sign.

The current Act on the Registration of Yachts and Other Vessels up to 24 Meters in Length and its implementing acts establish a new method of cooperation between the registry of yachts and the Office of Electronic Communications, which should facilitate the handling of formalities.

As a result of these changes, when a radio license is issued for the use of radio equipment in the maritime and inland radio communication service, and in the event of an amendment to or revocation or expiry of that license, the Office of Electronic Communications will promptly enter such details in the new registry (within a maximum of 24 h).

The registry entry contains the following details:

  • the call sign or the marine MMSI number;
  • the term of validity or the date of revocation or expiry of the radio license;
  • the type of equipment.

This means that the Office of Electronic Communications will remain in constant cooperation with the new national registry and be able to enter its data using ICT systems.

The owner of the vessel having been awarded their radio license will not have to worry about the status of their entry in the registry of yachts, as it will be automatically updated with the new details.

EMERGENCY RADIO BEACONS 

Given existing EU legislation and the widely-defined safety of navigation, one’s EPIRB beacon reported to the Office of Electronic Communications must be registered with the Civil Aviation Authority which, similarly to the Office of Electronic Communications, is expected to maintain permanent cooperation with the new registry and is obliged to promptly enter in the registry the following details:

  • information on which action has been performed: an entry in the records, an amendment to an entry, or removal of an entry from the records;
  • the date of the entry in the records, amendment of an entry, or removal of an entry from the records;
  • the identification code of the emergency beacon.

The above are just some comments on the new rules.

BENEFITS OF YACHT REGISTRATION IN POLAND

We could now try to present some pure benefits of yacht registration in Poland:

  • registration of yacht in the Polish register is indefinite;
  • the applicant can be not only Pole but also an EU citizen;
  • the registration process is relatively quick;
  • one-time payment at no additional cost (for recreational yachts);
  • yachts registered under the Polish flag are widely accepted and recognized around the world;
  • registration of yachts up to 15m runs smoothly, the owner does not need to perform additional inspections and safety inspections – registration of yachts of such dimensions is most beneficial for foreigners in Poland;
  • registration of commercial yachts is also possible – however, as in the case of yachts over 15m, the owner will have to perform mandatory periodic inspections and safety inspections, which will incur additional costs, such as payment of all costs associated with the travel of inspectors from the Maritime Office to the designated location

We may already summarize, that the Polish flag has been still attractive to EU yacht owners, especially to yachts under 15 m.

In fact, if your vessel is below 15 m and you use it recreationally, the polish flag is probably the best option for you.

Do I need to pay VAT for my Polish registered yacht?

A boat in EU waters belonging to an EU citizen, or flying the flag of a EU country, must be VAT paid

VAT tax and yachts in the European Union: Value Added Tax (VAT) is an EU tax levied on consumption by the government of each member state. Yachts imported into the EU and yachts purchased by EU owners who use their yachts in the EU are obligated to pay VAT.

Any yacht owned by any nationality that spends more than 6 months in any calendar year in EU waters is subject to VAT. EU residents can only use a yacht in the EU if it has paid VAT.

Each member state interprets, implements, administrates and enforces EU VAT rules according to their own discretion. VAT rates differ according to individual member state rules. Normally, the local customs authority enforces the relevant VAT rules.

A yacht owned in the EU has the right to move freely throughout the EU, provided VAT has been paid on that yacht in any EU country.

If the yacht spends more than 6 months in some EU countries, it may be subject to local laws.

What VAT documentation is required?

Each yacht needs some proof of VAT payment onboard the yacht; such as a paid invoice or VAT certificate, when sailing in EU waters. If the yacht is exempt from paying VAT, documents stating the reason for the exemption issued by customs or other appropriate authority need to be onboard.

Any yachts built or brought into the EU on or after January 1, 1985 must be able to prove its VAT status.

Yachts built or brought in the EU before January 1, 1985 are considered to have paid VAT status if privately owned and operated in EU territorial waters until December 31, 1992. Proof of this status may be required by local customs officials. Documentation such as logbooks, receipts or invoices from European marinas may be used. If it is not possible to provide documents confirming the yacht's location on December 31, 1992, all relevant documents should be presented and local customs authorities will make a determination.

When a European buyer purchases a yacht, an appropriate document from the seller or his broker should be requested confirming its VAT status. Yachts built after January 1, 1985, VAT should be paid by the original buyer or importer. The proof may be an original invoice or a VAT certificate. Certified copies can be used in lieu of originals.

If a company sells the yacht, and they recover the VAT, the new buyer will pay for the yacht with VAT added. There will be a sales contract that proves that VAT was paid.

If the original buyer is an individual (not a company) and paid VAT, they should transfer this VAT paid status to the new buyer and will not recover any VAT. The yacht will keep its VAT paid status after it changes owners.

Can the yacht lose its VAT paid status? If a yacht with VAT paid status was exported from (or sails out of) the EU, it will normally qualify for a VAT exemption if it is brought back into the EU within 3 years of exportation. This only applies if it is brought back by the same person who left with it. This means no change of ownership can occur outside the EU. 

When is the VAT due to be paid? VAT is payable in the event of a chargeable event. A chargeable event occurs when a yacht is imported into the EU or sold by a company in the course of an operating activity.

If you are buying a yacht from a company that does not collect VAT on sales or from an EU private individual and the seller reports that the VAT has been paid before, you should get evidence from the seller or broker that this has happened.

Yachts imported from outside the EU, must pay VAT at the place and time of importation. VAT is assessed on the value at the time of yacht's importation. Customs may require additional pricing from brokers if they believe the real value is less than claimed.

What to do if VAT cannot be proved and there is no chargeable event? You must keep any available invoices or logs from the yacht. Some customs authorities may want to see the available documentation and may issue a letter of guarantee that the yacht is paid for VAT. Such a letter does not prove that VAT is considered to be paid. For yachts built before January 1, 1985 and in EU territorial waters on December 31, 1992, such documentation and requests for a letter of recommendation must be submitted to the customs authority of the country where the yacht was on December 31, 1992.
