European yacht charters are growing in popularity for the more experienced charterer - even when leaving aside the most popular Mediterranean counties. Anyone on a yacht charter holiday in the British Isles or Europe will experience great cultural and scenic variety. There are also yacht charter locations for every level of skill, experience and budget from the shallow east coast of England to the rugged highlands of Scotland and the soaring fjords of Norway. Scotland can sometimes be tranquil and sometimes rugged; Britain can be sometimes busy and sometimes deserted; Brittany can be sometimes sunny and sometimes rainy. No matter what you desire you will no-doubt encounter a concentration of history and culture.

Europe is one of the world's seven continents. Europe stretches from the westernmost peninsula of Eurasia, to the Ural and Caucasus Mountains in the east where is it 'divided' from Asia. Europe is bordered by the Arctic Ocean and other bodies of water to the north, the Atlantic Ocean to the west, the Mediterranean Sea to the south, and the Caspian Sea, Black Sea and connected waterways to the southeast.

‘Europe’ therefore does include countries that borders with the Western Mediterranean Sea such as the popular yacht destinations of Spain, France and Italy, however these well developed yachting destinations found in Southern Europe are discussed in more detail under the Western Mediterranean yacht charter section .

Northern Europe has all the main types of yacht charters available in the United Kingdom (England, Ireland, Scotland, Wales) Scandinavia (Denmark, Norway and Sweden) Germany and Russia, including motor, sailing, skippered, crewed yachts, catamaran, power boat, sailboat, luxury yachts and motor yachts. There are also more and more superyachts that visit the area, available for charter including explorer yachts or expedition yachts. Weather patterns make Northern Europe’s summer charter season shorter than that in the Mediterranean, which is why fewer luxury yachts tend to be permanently based in Northern European waters. Summer, from May to about September, is the main season and the best time to charter a yacht in Europe.

Hi Amanda, The boat was great. The staff were too. Marin in particular. He was super knowledgeable and we felt in good hands. I'd say that maybe a very slight comment is that a Croatian crew and cooking etc is always going to be a little more "Eastern European" than, say an Italian crew. This is not to say it was lacking, just a little different and perhaps requires a little more communication. Thanks for everything. Was really a wonderful holiday I'd love to do a boat trip again. The Charter of Yachts in the European Union

Introduction.

It is the purpose of this guide to set out some of the principal considerations for the charter of yachts in the EU from a legal and fiscal perspective.

Yacht Ownership

One of the key first steps is to decide on a suitable location for the establishment of a corporate structure to own the yacht and act as the charter business.

Usually the owner will seek legal and tax advice from their accountants on where best to incorporate the yacht charter business as the best choice of jurisdiction will depend heavily on the client’s own personal circumstances.

EU companies or a company incorporated in a country or territory that holds a double taxation agreement with the relevant EU member state where the vessel will charter are commonly used to avoid withholding tax on charter income and cabotage restrictions in certain EU states.

Yacht Registration

In parallel to the set up of the yacht charter business it is important to determine the most suitable flag state for the registration of the yacht.

The registration of the yacht is an important decision determining the vessel’s nationality and in turn the applicable operating system. Yachts operated for commercial activities such as charter must hold a registration allowing them to operate commercially under its flag state rules.

It is important to select a flag state that holds a high ranking under the Paris Memorandum of Understanding in respect of Port State Control as well as providing yacht friendly interpretations of international maritime standards for commercial yachts.

Yacht Operation

In tandem with flag state selection consideration must be given to how the yacht will comply with operational rules and regulations including, for example, minimum safe manning levels, safety management systems and labour laws.

Fiscal Compliance

It is important that the yacht charter operation is conducted in compliance with the relevant EU fiscal regulations and any local legislation, for example:

• The yacht should be formally imported into free circulation within the EU.
• The yacht owning company and vessel should comply with all relevant local VAT and fiscal regulations, i.e. VAT registration in the member states from where it will commence charters.
• VAT should be charged and accounted for on all charters (including charters undertaken by the underlying owners and their friends or family).
• Income should be declared and, where applicable, tax should be paid to the relevant member state. .
• The yacht owning company and vessel must comply with all relevant local regulations, i.e. charter licence in Spain.

VAT Exemption

Yachts that are run as earnestly pursued commercial businesses can in certain circumstances qualify for VAT exemption on the yacht itself and certain supplies.

There are many ‘business tests’ to ascertain whether the operation can benefit from VAT exemption varying between EU states but typically the authorities will expect to see a bona fide yacht charter business demonstrating the following commercial characteristics:

• A central professional charter agent must be appointed and vessel must be marketed for charter at a reasonable market rate compared to other similar vessels.
• All usage of the vessel by guests must be performed under a charter agreement, (including any usage by the underlying owners and their friends or family).
• Charter by the underlying vessel owners and their friends or family should be proportional to the amount of actual third party charter activity.
• The owning company must be able to show the receipt of charter proceeds onto an account of the company.

As a caution, yachts benefiting from VAT exemption face constant scrutiny from the EU authorities who take steps to check that owners are not using the yacht charter model as a method of VAT avoidance. In summary any arrangement whereby the principal purpose of which is to obtain a VAT advantage, and which is lacking is an underlying commercial objective, may be challenged by the EU authorities as being abusive.

“The existence of one or more of the following features might indicate an abusive structure (the list is not exhaustive – the indicators are illustrative of the points that HMRC might take into account, together with others):

• The main user of a pleasure craft is the ultimate owner of the chartering or leasing entity.
• The main user of a pleasure craft funded the purchase of the vessel (directly or indirectly).
• The person who funded the purchase of a pleasure craft (directly or indirectly) uses the vessel for prolonged periods in the peak chartering season.
• The chartering of a pleasure craft to third parties would not, alone, be of sufficient continuity and substance to comprise an economic activity.
• The chartering or leasing entity shows significant ongoing losses in its financial statements.
• Charter fees or lease instalments due from the main user of a pleasure craft are paper transactions only (for example being offset against loans).
• Charter fees or lease instalments are below open market value.
• The terms of a lease differ significantly from normal commercial practice (for example, the duration of the lease is unusually long).”

Caveat & Conclusion

As a caveat we would stress that we are a yacht registration and documentation agency and not legal and/or tax advisers so none of the foregoing information should be treated as any kind of formal legal or tax advice. Readers are therefore advised to take appropriate professional advice specific to their individual circumstances before taking any action based on the contents of this or any other page of this website or any correspondence with ourselves.

As the rules for the charter of yachts varies considerably between EU member states we would always suggest taking local advice before the commencement of any charter activity in any particular country.

How Do US Owners Charter Their Yachts in Europe?

Many us yacht owners want to cross over to europe to enjoy one or more seasons in the cruising grounds offered within the mediterranean..

If these owners wish to charter their yachts during this period in EU waters, this is certainly possible, but a number of important issues relating to EU VAT need to be addressed.

Typically US owners of superyachts hold their yachts via a corporation. Many are held by Cayman Island corporations and often accompanied by a Cayman Island registration/flag. Some of these vessels may have operated as charter vessels in the EU during previous seasons and can continue to do so, but certain considerations need to be made.

Whilst some may view the requirements for EU chartering as complex and confusing, the rules now are in fact much clearer and in most EU member states there is greater clarity. Much of the recent uncertainty related to non-EU flagged vessels and whether these vessels can legitimately undertake charter activity throughout the EU.

The 2 options for charter operations in the EU are:

• Operate under the YET scheme (limited cruising area for charters)
• Bring the yacht into Free Circulation as part of  a commercial charter operation. 

Before any yachts can charter in the EU, they must be deemed as EU goods. Therefore each yacht must be formally imported into the EU and VAT thereon must be accounted for. Again this may sound onerous, but in fact a correctly organised yacht importation is again a straightforward process, provided sufficient notice is given.

The owning company must have an EU VAT registration. This may be in one or more EU jurisdictions and must facilitate payment of VAT on charter fees to the relevant member state. This may sound onerous, but is in fact a relatively straight forward process, even for a Cayman, or other non-EU corporations.

The key to successful chartering is to meet the relevant criteria. Failing to do so is inevitably the cause of a disrupted charter. Whether the vessel is a large Cayman flagged, US owned vessel or an EU flagged and owned vessel, meeting the criteria is not a big undertaking.

Over 100 charter brokers attend the show, which will feature sailing and motor vessels ranging in size from 50 to 200+ feet. While the charter guests who appear on Below Deck have a great time while filming the show, many aren't invited back for a number of reasons.

• Some charter guests on Below Deck have caused unnecessary drama and won't likely return due to bad behavior.
• Captain Glenn Shephard from Below Deck Sailing Yacht faced backlash from Barrie, who called him two-faced.
• Former guest Dr. Francis Martinis will not return to Below Deck after he was arrested for faking prescriptions.

The Below Deck franchise has featured many charter guests since 2013, many of whom will never return . The Bravo series focuses on expensive charters with wealthy guests who have attitude problems and over-the-top demands. That includes Charter guest Alexis Bellino, who boarded Captain Lee Rosbach’s yacht with her boyfriend at the time, Andy Bohn. She was disrespectful and made everyone uncomfortable with her and Andy's PDA. She even insulted crew members after featuring on the show.

Like Alexis, Delores Flora from Below Deck season 8 was a terrible guest. Not only did she misbehave, but she also got drunk and s wam while intoxicated, which is not only not allowed, it frightened the crew members. Delores got kicked out of the yacht the next day. These guests created unnecessary drama on the boat and will likely never return like a few others from the franchise.

Barrie and Tony Drewitt Barlow had a decent time in the Below Deck Sailing Yacht seasons 2 and 3. Despite that, they left with a bitter taste because of Captain Glenn Shephard. In 2021, Barrie participated in a podcast, Pita Party: The Podcast , where he claimed that Captain Glenn bothered him while using his phone .

Barrie said, “he (Captain Glenn) was a two-face b*stard,” adding that he just didn’t like his presence.

Even if Kyle quits, Frank wouldn’t want to be in an environment that would remind him of his failed relationship.

Erica Rose appeared on Below Deck Sailing Yacht two seasons in a row. Erica was highly offensive toward the crew member, as well as her husband, Charles Sanders, and to make things worse, she left the crew with a measly tip , leading fans to slam her on social media. Overall, the experience was simply terrible on both sides. Crew members didn’t love Johnny and his wife, and the couple didn’t respect the crew members. It is unlikely that Captain Sandy would want to host the couple again as long as she’s in charge.

3 Krystal Murphy

Former charter guest Krystal Murphy boarded Captain Lee’s yacht with her friends. She immediately began showing red flags, drinking, and just being a menace. Krystal fought with her friend, Chelsea, creating unnecessary drama. She even passed out and punched a friend in the face. Former Chief Stew Kate Chastain disliked serving Krystal and called her a “spoiled brat;” she wanted to throw her off the yacht. Nowadays, Krystal has seemingly become a more private person. It doesn’t seem like Krystal would want to be on TV again.

2 Steve Bradley

Below Deck fans should remember Steve Bradley as he made many appearances on the show. In Below Deck season 3, he wanted a foam party and demanded the crew to figure it out and follow his commands, acting like a king. In Below Deck season 6, Steve made more outrageous requests. Apart from being a wild guest, Steve was entitled and acted inappropriately at times . No Below Deck captain would want to host him again as he didn't come off as very likable.

While the former charter guest didn’t have too many issues on the show, his personal life issues will stop him from appearing on Bravo again. According to TMZ , Dr. Francis and his wife, Jessica, were arrested for filling out fake prescriptions in December 2023 . The couple used the names of Below Deck stars and got caught red-handed. The Below Deck franchise would never want to welcome felons, especially when their mugshots are all over the internet.

Kamaz FTL hauler registers NatCar brand

MOSCOW. Sept 4 (Interfax) - National Carrier JSC, the full truckload freight trucking company headed by former Globaltruck CEO Ilya Sattarov that Russian truck maker Kamaz founded this summer, applied to register the brand NatCar at the end of August, the registry of federal intellectual property service Rospatent showed.

The NatCar brand is also mentioned in the recruitment ads of National Carrier, which is actively looking for E-class drivers. It is offering working with this year's model Kamaz diesel trucks from the flagship K5 line and new dry goods (curtainsider) and refrigerated trailers.

National Carrier was founded on July 7 in Moscow with charter capital of 1 billion rubles, the Unified State Register of Legal Entities showed. The company registered two branches in early August, in Yekaterinburg and Elektrostal, Moscow Region. The company specializes in truck logistics and associated activities, including digitization processes.

A spokesman for National Carrier told Interfax earlier that the company plans to provide FTL trucking services using its own fleet, "as well as the resources of hired truckers." The company's fleet will initially consist of 400 semi-trailer trucks with a 50/50 ratio of curtainside to refrigerated trailers, and it plans to primarily operate on domestic routes, he said.

The company has preliminary agreements with major customers among marketplaces and retailers in the FMCG and DIY segments, the spokesman said. Strong demand for trucking services is expected toward the end of the year, so there is interest from customers, he said.

Kamaz marketing director Ashot Arutyunyan announced at the International Moscow Automotive Forum at the end of August that the truck maker was the principal investor in National Carrier. He did not comment on the new company's shareholder structure, but said it is a Kamaz startup.
