The 7 superyacht concepts that got everyone talking in 2023

What makes a superyacht concept stand out? When the only limit is a designer's imagination, the results can sometimes be extreme – but more often than not, a pioneering design comes to the fore. BOAT takes a look at what set apart this year's most impressive entries...

Length:  131m Designer:  Giles Taylor, Oceanco , Lateral Naval Architects and Njord by Bergman Standout feature : Eco-minded interiors

Named after the Greek god of wind, Aeolus takes after its elemental namesake with a fluid, organic exterior design. A beam of 18 metres and gross tonnage of 6,200 has allowed for a number of multi-functional areas, including "pod-like" spaces that prioritise privacy and more open areas with sweeping views through large glass windows. This project's interiors focus on sustainable “biomaterials”, including vegan leather made from cactus and organically certified cotton.

Length: 88m Designer : Jozeph Forakis , Lateral Naval Architects Standout feature : A world first in construction

Pegasus was presented in February as the world’s first "3D-printed" superyacht. Mirrored glass and a tiered superstructure allow the vessel to blend in with the surrounding landscape, while the interior centres around a multi-level "Tree of Life" hydroponic garden, designed to provide guests with fresh food and air purification. Aft, an open beach club with Jacuzzi can transform into a solarium.

Length: 83m Designer: Feadship , Studio De Voogt Standout feature : A never-before-seen mast design

Dunes' unconventional design (meant to mimic undulating waves of sand) is paired with eco-minded features that include a signature cooling mast design, extra-capacity storage batteries, a new type of fuel cell and a radical propulsor. According to the shipyard, if built Dunes would eliminate up to 95 per cent of the potential negative environmental factors associated with operating a superyacht.

Length: 80m Designer: Sinot Yacht Architecture & Design Standout feature : Clever use of onboard space

Unveiled in September, this ready-to-build superyacht proposal focuses on maximizing onboard space within the yacht’s slim, limited structure. Open-plan, flexible layouts prevail, seen best in the beach club which has head heights of three metres, fold-down terraces and integrated sliding glass partitions. The Dutch studio has a number of award-winning yachts in its portfolio, including the 60-metre Heesen yacht Lusine and the 77.2-metre Pi .

Length: 65m Designer: Golden Yachts , Phathom Studio Standout feature: The loft-like owner's cabin

October saw the reveal of Vesper, a project "more akin to an architectural residence than a typical 65 metre superyacht". This is realised most clearly in the owner's cabin, which spans a two-level apartment and includes a his-and-hers en suite, a wardrobe and a large open-connect lounge with an adjoining study. Pantograph doors lead to a private balcony with an infinity-edged spa pool, rock water wall and an outdoor lounge area.

6. Project Stardust

Length: 63m Designer: Tankoa Yachts , Giuseppina Arena , Abbasli Design Studio Standout feature: An unusual crow's nest

This celestial concept was unveiled at the Fort Lauderdale International Boat Show with the help of yachting influencer Denis Suka (also known as The Yacht Mogul). Tankoa explained the yacht's namesake – by night, exterior decks are illuminated by a collection of twinkling lights that turn the yacht into an "interstellar spaceship". Another unique feature is the observation deck-crow's nest hybrid, which creates an open-air setting for enjoying while underway or at anchor.

Length: 58m Designer: DRIFT Energy, ShadowCAT Standout feature : Environmental potential

Short for "Most Valuable Yacht" (referring to its green credentials), this megawatt-class support vessel will be capable of generating, storing and delivering energy by itself. Turbines will capture the kinetic energy of the vessel and store it onboard as "green hydrogen", to be later offloaded at a designated port. According to the company, this concept has the potential to abate a gigatonne of CO2 by 2050.

Oceanco Koru Superyacht

With a combined length of 2,929 feet, the world’s top 10 superyachts scheduled for delivery this year are moving away from the idea that yachting is about whose boat is bigger. The trend is now more about mission than size. This year’s launches will be wide ranging, from motoryachts to sailing vessels, explorers and even a giant sportfish.

The list includes offerings from German shipyard Lürssen , which has two 400-foot-plus yachts ready to splash this year, with noteworthy deliveries from other shipyards in Germany, Italy, and the Netherlands showcasing different definitions of design, power and performance.

Here are the yachts we can’t wait to see.

‘Koru’ (564 feet) Oceanco

Jeff Bezos’ first yacht, Koru , was spotted last week on sea trials. The Amazon founder chose to make a bold design statement by commissioning the world’s largest sailing yacht, not to mention the longest pleasure vessel, motor or sail, ever from The Netherlands. Built by Oceanco, the titanic sailing machine is an incredible 3300 GT, powered by kinetic energy generated by the sails. Besides its massive length, its classic canoe stern, a double-deck wooden coach house and navy hull with a red stripe differentiate Koru from any other vessel on the water. The project remains hush-hush. Even the designers remain a secret.

‘Liva’ (387 feet, 1 inch) Abeking & Rasmussen

Launched late last year and scheduled to be delivered in early 2023, Liva is the largest yacht built by Abeking to date, overtaking the German shipyard’s previous flagship Aviva by 65 feet. The French studio Joseph Dirand Architecture was commissioned to pen both the exterior and interior, which is reported to include a semi-submerged underwater observation room on the lower deck, a supersized pool, helipad, spa with sauna and beauty salon, and a lower-deck beach club.

‘Alchemy’ (216 feet, 5 inches) Rossinavi

Commissioned by a private American client, the 216-foot multi-deck motoryacht Alchemy is one of three yachts to be launched by Italian shipyard Rossinavi in 2023. Exterior design is by Philippe Briand, with interior styling by Enrico Gobbi’s Team for Design. Little information has yet to be revealed, though it’s visible from images that the custom yacht features an axe bow, drop-down side terraces at the stern and large floor-to-ceiling windows that afford views from all levels.

Project Jag (400 feet) Lürssen

The 400-foot displacement motoryacht known only as “Project Jag” is reported to be the owner’s third Lürssen. His most recent is Kismet . It is set for delivery in late 2023. Capable of sleeping 20 guests and 40 crew, the gigayacht is equipped with a helipad, spa, swimming pool, two cinemas, gym and storage for a sub. Italian design firm Nuvolari Lenard designed the steel yacht’s exterior, while UK studio Reymond Langton has crafted what is rumored to be a “bespoke homage to the owner’s lifestyle”—whatever that means.

Project Luminance (426 feet, 5 inches) Lürssen

Project Luminance is a 426.5-foot motor yacht that Lürssen claims will be one of the largest and most technologically advanced boats in the world. It’s also the largest yacht due to deliver in 2023. Construction began in 2018, yet few details have been revealed. What we do know is that the seventh-largest project to ever come out of the German shipyard to date features state-of-the-art propulsion systems, advanced navigation and communication systems, as well as next-generation entertainment.

‘T52’ (170 feet) Baglietto

The first model in Baglietto’s T52 line, which splashed in February 2023, features sleek lines and aerodynamic grills penned by Francesco Paszkowski Design. Power comes from a diesel-electric-hybrid propulsion system. The yacht celebrates outdoor space, including a large multi-level beach club at the stern with a fold-down transom, oversized sunbeds and a swimming pool with a floor that rises flush with the deck. Sliding windows on the upper deck convert space into an open-air sky lounge and a 78-foot sundeck with a glass-encased hot tub.

Project 406 (170 feet, 6 inches) Royal Huisman

The Dutch shipyard Royal Huisman made its name building some of the world’s largest sailing yachts, including 296-foot Athena , but now it’s hitting the record books again with the impending launch of Project 406 , the world’s largest sportsfisherman. Naval architecture, exterior and interior are by Dutch studio Vripack. The firm gave the six-decked aluminum yacht a towering profile promising spectacular front-row views of the big game fishing action. The team balanced its height by a long bow, high bulwarks and uncluttered fishing cockpit.

‘Black Shark’ (252 feet, 6 inches) Nobiskrug

Black Shark first began construction in 2019, but all work ceased when Nobiskrug later filed for insolvency. In March 2022, following the German shipyard’s acquisition by entrepreneur Lars Windhorst, work on Black Shark recommenced, with delivery set for 2023. The 252-foot boat, designed by Winch Design, gets its name from its predatory profile and mast shaped like a dorsal fin. A reverse bow, black matte hull and metallic silver superstructure will also help to enhance the marine connection.

‘Ultra G’ (196 feet, 8 inches) Heesen

Heesen is renowned for building fast boats, so it’s no surprise that Ultra G , equipped with a propulsion package totaling 22,000 horsepower, with four water jets and a top speed of 37 knots. The Dutch yard hailed this as its most powerful project to date. The motoryacht was commissioned by an avid sportfisherman, with a fighting chair and storage for 40 rods. Entertainment was also a big mandate for the design, stretching from Samsung’s “The Wall” screen, an infinity pool, and a dedicated self-cleaning “dog park” for furry guests.

‘Maverick’ (145 feet, 3 inches) Cantiere delle Marche

Maverick is the first Flexplorer 142 to soon be delivered by Cantiere delle Marche (CdM), bought by a young German who is a keen sailor and serial owner of both sailing boats and motoryachts. The owner’s itinerary will see him cruising the Mediterranean, before heading to the Northern latitudes to cross the Northwest Passage and put Hydro Tec’s bold exterior design and running surface to the test. Key features include a custom-built A-frame crane that sits flush on the deck when not in use, collapsible bulwarks that fold-down to reveal a 1,450-square-foot beach club, and an infinity pool at the transom.

Superyachts aren’t just for the super-rich: Hundreds of scientists have used them for ocean research

For almost two years, Robert Brewin collected data from the bow of a superyacht as it sailed pristine waters from the Caribbean Sea to the Antarctic Ocean. 

The  Archimedes , a 222-foot (68-meter) “adventure” yacht then owned by the late hedge funder James Simons, boasts a gym, a jacuzzi and an elevator. But between 2018 and 2020, Brewin was concerned only with the boat’s Sea-Bird Scientific Solar Tracking Aiming System, installed to measure light reflecting off of the water. A senior lecturer at the UK’s University of Exeter, Brewin and his colleagues were analyzing microplankton — microscopic organisms at the base of the marine food chain — by studying the ocean’s color. The Sea-Bird’s readouts helped them verify satellite imagery. 

Brewin’s was not your typical superyacht itinerary, but he is one of hundreds of scientists to have used an adventure yacht — also known as expedition or explorer yachts — to conduct research on the ocean. In a  paper  published in January, Brewin and his co-authors touted the potential of “harnessing superyachts” for science, concluding that “reaching out to wealthy citizen scientists may help fill [research capability] gaps.” 

It’s a view shared — and being pushed — by the Yacht Club of Monaco and the Explorers Club, a New York City-based organization focused on exploration and science (of which, full disclosure, I am a member). In March, the groups co-hosted an environmental symposium that included an  awards ceremony  for yacht owners who “stand out for their commitment to protecting the marine environment.” The  Archimedes  won a “Science & Discovery” award. 

“If a yacht is operating 365 days a year, rather than having it sit idle it’d be much better for it to contribute a positive return through science and conservation,” says Rob McCallum, an Explorers Club fellow and founder of US-based EYOS Expeditions, which runs adventure yacht voyages. 

EYOS charters yachts from private owners for its excursions, and is a founding member of Yachts for Science, a four-year-old organization that matches privately owned yachts with scientists who need time at sea. (Other members include yacht builder Arksen, media firm BOAT International, and nonprofits Nekton Foundation and Ocean Family Foundation.) Yachts for Science will enable about $1 million worth of donated yacht time this year, McCallum says, a figure he expects to hit $15 million by 2029. 

“There’s a personal satisfaction that we are contributing to something that is bigger than us,” says Tom Peterson, who co-owns an insurance underwriting company in California and has what he jokingly refers to as a “mini superyacht.” Every year for the past decade, Peterson has donated about 15 to 20 days of time and fuel on the 24-meter  Valkyrie  to scientists, who he takes out himself as a licensed captain and former scuba dive operator. He often works with the Shark Lab at California State University Long Beach, and allows researchers to stay aboard for days at a time instead of having to constantly make the 1.5-hour trip to and from shore. 

To link up with scientists, Peterson works with the International SeaKeepers Society, a Florida-based nonprofit that engages the yachting community to support ocean conservation and research. “The more we understand things about the ocean in general, the better we all are in the long run,” he says. 

When “superyacht” and “the environment” appear in the same sentence, it’s usually in a different context. In 2019,  one study estimated  that a single 71-meter superyacht has the same annual carbon footprint as about 200 cars. In 2021, another  paper  found that superyachts were the single greatest contributor to the carbon footprint of 20 of the world’s most prominent billionaires, accounting for 64% of their combined emissions.

“If you really want to respect the environment, you can just go surf,” says Grégory Salle, a senior researcher at the French National Centre for Scientific Research and author of the book  Superyachts: Luxury, Tranquility and Ecocide . Salle is open to the idea that superyachts could be used to advance scientific research, but says it’s contradictory for anyone to buy a superyacht and claim to be truly concerned about the environment.

McCallum says people who own adventure yachts tend to be younger than your standard superyacht owner, and have a particular interest in remote and pristine places. “They’re not the sort of people that are content to just hang out in the Mediterranean or the Caribbean,” he says. “Antarctica, the Arctic, the remote Indian Ocean, the remote Pacific Ocean, the Subantarctic islands… that’s where you’re going to find us delivering our services.”

Explorer yachts aren’t the only way scientists can reach those destinations, but demand for dedicated research vessels does outstrip available supply. The US National Oceanic and Atmospheric Administration (NOAA), arguably the world’s greatest collector of oceanographic data, has a fleet of  15 research and survey vessels  for the use of its scientists. Academic researchers can also apply to use the fleet, often at a subsidized rate. But scientists request roughly 15,000 to 20,000 days of boat time every year. In 2019, NOAA was able to fill just 2,300 of them, according to an internal study.

That gap is particularly problematic as the planet warms. Oceans provide services that scientists call “ existentially important ,” producing more than  half of the oxygen we breathe  and serving as the world’s  largest carbon sink . They also absorb  30% of our carbon emissions  and  90% of the excess heat generated by them .

G. Mark Miller, a retired NOAA Corps officer who was in charge of several of the agency’s research vessels, has a different solution in mind when it comes to bolstering ocean research: smaller boats, fit for purpose. Superyachts can cost north of $500 million, he says; “why don’t we build a hundred $5 million vessels and flood the ocean science community?” 

After leaving NOAA, Miller in 2021 launched Virginia-based Greenwater Marine Sciences Offshore with a vision of building a global fleet of research vessels and offering their use at affordable prices. He says hiring a NOAA boat can cost scientists between $20,000 and $100,000 per day. GMSO plans to charge less than $10,000 a day for most missions. The company says it’s close to acquiring its first three vessels.

Miller hopes his business model will help scientists conduct the work they need to — particularly in under-served regions like the Asia-Pacific — without worrying about getting a luxury yacht covered in “muddy worms, plankton goo, dead fish [and] whale snot.” He describes yacht owners donating boat time to scientists as “better than nothing,” and says it can help get regular people interested in science and exploration. 

Christopher Walsh, captain of the  Archimedes , says he and his crew love taking part in science initiatives, especially when there’s an educational component. “I get a real thrill when we can stream to the classrooms — you can’t imagine the enthusiasm the kids display,” Walsh says. “That gives me a lot of hope for the future.”

Superyachts of the Future Will Include This Shocking Design

A “gaping hole” in the middle of your boat might sound like a major structural issue, but it’s actually the design focus of Shape, Lazzarini Design’s new 226-foot superyacht concept.

Accessible through a door in the bow, the customizable “void” is fitted with portside steps to take passengers down to the ocean for a dip. If you’re not that adventurous, though, there’s also a glass-bottom infinity pool on the upper deck that dips down into the hole and allows swimmers to observe those below.

A sun lounge and diving platform are situated on the stern, while the living area at the bow offers 115 feet spread across three decks—six luxury suites on the first level, shared crew living quarters on the second, and a command center, helipad, and private Jacuzzi on the third.

“Shape stands out from the rest by avoiding an unnecessarily elaborate design and by instead having a striking silhouette,” the studio says of the sleek silver craft.  “Because we placed a void inside the concept’s superstructure, there is a real luxury quality about the living space.”

Italian designer Pierpaolo Lazzarini, 39, is known for playful and futuristic concepts for watercrafts, most notably his “jet capsules” and a 450-foot swan-inspired yacht concept, Avanguardia .

But Shape was also crafted with an eye toward sustainability: It will run entirely on clean energy, with a hydrogen-powered propulsion system and a large solar panel on the sundeck that provides electricity for all onboard systems.

Feadship Delivers 84m OBSIDIAN: The Future of Superyacht Sustainability

84.20m OBSIDIAN is Feadship's first delivery of 2023. She represents a significant step towards Feadship's goal of producing carbon-neutral superyachts by 2030. She is the first of Feadship’s new generation of superyachts furthering carbon reduction through a variety of innovative methods.

OBSIDIAN was built with the intention to be even more energy efficient than SAVANNAH, Feadship’s ground-breaking hybrid yacht launched in 2015. Through hulls optimised at cruising speed, weight control, advancements in electric propulsion, and the ability to run engines on HVO, a non-fossil diesel fuel which reduces carbon emissions by 90%, OBSIDIAN represents the future of sustainable yachting solutions. She has 4.5 times more electrical storage capacity than SAVANNAH along with no draft shafts or rudders, preventing added drag. Whereas SAVANNAH and LONIAN operated on 560 volts, OBSIDIAN is a 1000-volt system as she is fully powered by electricity. 

A key focus for fuel savings onboard OBSIDIAN is capturing “waste” heat to use for other purposes. Waste heat is captured from the generators and from the AC chillers themselves, the AC being the largest consumer of energy. This energy is essentially carbon-free as it reuses incidental heat generated by another function. Mark Jansen, Project Manager, has recognised the success of energy saving onboard OBSIDIAN: ‘There are so many points of energy savings integrated on this yacht that it is hard to count’. 

An innovative heat pump system which transforms thermal energy from one place to another is used to pull heat from various sources. According to Jongepier, it is five times more efficient than making heat with a regular electrical heating coil. A computer system onboard helps to choose the appropriate combination of sources which translates into a number of operational modes. 

OBSIDIAN’S hull form contributes to the advanced sustainable nature of the yacht. She has a low, slim hull optimised at cruising using computational fluid dynamics (CFD). Carbon fibre has been effectively used for weight reductions, a complex engineering method which also offers new deck layout possibilities. 

The volume of OBSIDIAN is typical of that on 100m Feadships. The single level engine room leaves more scope for interior layout, and she features a total of seven staterooms. Her bold and modern exterior translates to the interior design, both penned by RWD in collaboration with MONK Design. From a spectacular Aqua Lounge to an observation lounge with floor-to-ceiling windows offering stunning views, the interior design of OBSIDIAN is just as impressive as her advanced sustainability. 

Bram Jongepier, Senior Designer at Feadship De Voogt Naval Architects, developed a sustainability index, which became known as YETI: the Yacht Environmental Transparency Index. This is a guide which shows how all of a yacht’s operations and components contribute to its carbon profile and environmental impact. This shows how Feadship goes further than just reducing CO2 emissions by addressing the overall environmental impact of its vessels. This tool is significant in relation to OBSIDIAN as it can show just how much of a step forward she is with regards to sustainability, showcasing the success of Feadship’s environmental developments. 

YETI operates on the philosophy that one cannot control what one cannot measure. The algorithms describing the environmental impact of individual components, for instance CO2 emissions, have been made freely available by Feadship to the signatories of the Water Revolution Foundation. This foundation is dedicated to driving sustainability in the superyacht industry, resulting in a Joint Industry Project (JIP) under the flag of the Water Revolution Foundation.

The YETI JIP produced a tool that is able to predict the environmental impact of an operational year in the yacht’s lifecycle. Using this tool, it is estimated that OBSIDIAN will operate with 27% less total environmental impact than a similar size yacht launched just five years ago if run on fossil fuel, and 60% less when using HVO.

Telosa's centerpiece is a lattice-like skyscraper called the Equitism Tower. Lore has hired  Bjarke Ingels Group (BIG)  to plan the project and the top architecture firm hasn't disappointed. They've created wow-factor renderings of the futuristic city, which will eventually occupy a 150,000-acre site somewhere in the arid west of the US. Telosa's centerpiece is a lattice-like skyscraper called the Equitism Tower. Consisting of a pair of hollow twin 'groundscrapers' measuring 1,640 feet tall, 656 feet wide and a staggering 106 miles long, The Line will be one of 10 'regions' that make up the $500 billion state and privately funded Neom zone, which according to  Dezeen  is "arguably the world's... most controversial architecture project." Located in northwestern Saudi Arabia, Neom encompasses a vast area around the size of Albania.

<p>In addition to The Line, three other Neom regions have so far been announced: Oxagon, an advanced port city with floating infrastructure, eco mountain resort Trojena and Sindalah, a sustainable luxury island resort destination in the Red Sea. The Supreme Court Is Fully MAGA-Pilled. The Time for Action Is Now or Never.

“We are in the process of the second American Revolution,” Heritage Foundation president Kevin Roberts thundered on Tuesday in celebration of the Supreme Court’s decision granting Donald Trump, and all future presidents, sweeping immunity from prosecution. This judge-led revolution, he added ominously, “will remain bloodless if the left allows it to be.” Kevin Roberts is not alone in cheering the Supreme Court’s hard turn to the right as a de facto revolution. The New Civil Liberties Alliance, a far-right group that welcomed coup abettors into its fold, trumpeted that “the dismantling of the unlawful Administrative State has officially begun” after SCOTUS overturned the 40-year-old doctrine of Chevron deference. Republican officials, commentators, and activists are jubilant over the court’s recent rulings , applauding them as the dawn of a new era in American governance. And they’re not wrong. While Democrats fret for a second week over the fallout from President Joe Biden’s disastrous debate performance, many Republicans seem to feel as if they’ve won already, entrenching many tenets of Heritage’s Project 2025 into law before a single vote has been cast.

The GOP’s triumphant attitude is neither premature nor overconfident. Four months out from November, the party has abruptly prevailed in many of its most important political battles, albeit in the cold, technical prose—you might even call it “bloodless”—of judicial opinions. The Supreme Court’s conservative supermajority has, in recent weeks, restructured American democracy in the Republican Party’s preferred image, fundamentally altering the balance of power between the branches and the citizens themselves. As the GOP became the party of coup denialism and unreconstructed Trump cultists, so too, finally, have the sober movement conservatives at the high court.

In the course of its most recent term that conservative supermajority has created a monarchical presidency, awarding the chief executive near-insurmountable immunity from accountability for any and all crimes committed during a term in office. It has seized power from Congress, strictly limiting lawmakers’ ability to write broad laws that tackle the major crises of the moment. And it has hobbled federal agencies’ authority to apply existing statutes to problems on the ground, substituting the expert opinions of civil servants with the (often partisan) preferences of unelected judges. All the while, the court has placed itself at the apex of the state, agreeing to share power only with a strongman president who seeks to govern in line with the conservative justices’ vision.

Someday historians will manage to explain why the same Roberts court that declined to rig the 2020 census in favor of Republicans, declined to intervene in the bogus 2020 election fraud cases, declined to rubber-stamp a wholly fabricated “Independent State Legislature Theory,” and refused to protect from investigation Trump’s personal papers and advisers made the sharp turn in 2024 to become his handmaids. At some point the rumors that there was a 3-3-3 court with a careful and moderate center became simply laughable, and those same “moderate” justices made the decision that whatever impulse toward public legitimacy had constrained their conduct in recent years was for suckers: Having taken on far too many high-profile game-changing cases, the choice for the 2023–24 term was go big or go home. They went big.

And make no mistake about it: When a court that has been battered by near-weekly reports of undisclosed oligarch-funded vacations (and gifts and super yachts and tricked out RVs and secret conferences with high-paying Koch supporters getting access to justices) decides to make it easier to bribe public officials— as it did in Snyder v. U.S. —that’s a very public signal that the conservative supermajority does not care what you think. When a court that has been caught with not one but two justices who have spouses who were excited by insurrectionist activity and symbols stands up those same justices as dispassionate and objective deciders of three separate Jan. 6 cases, that’s a very public signal that the conservative supermajority doesn’t care what you think. And when that self same court makes it illegal for homeless people to sleep in parks because not one of these members of the conservative supermajority will lose sleep over homelessness, climate change, housing policy, or any of the other root causes of being forced to sleep in a park, it’s a very, very public signal that the justices don’t care what you think. Whatever braking mechanism once existed at the court is now broken. We wake up this summer in a new government order.

To grasp the gobsmacking scope of this shift, start with Monday’s decision on presidential immunity and work backwards. In Trump v. U.S. , the Supreme Court’s conservative supermajority invented a new rule out of whole cloth, unmoored from any known constitutional text or principle, handing the president almost total immunity from criminal charges for his actions in office. Chief Justice John Roberts’ opinion purported to distinguish between “official acts,” which can’t be punished, and “unofficial acts,” which can. But Roberts also stacked the deck in favor of the president at every turn: He barred prosecutors from introducing evidence of “official acts” to prove culpability for “unofficial acts” and prohibited any inquiry into the president’s motives when “dividing official and unofficial conduct.” The result is a vast shield against prosecution that will hamstring prosecutors at every turn even if they decide that it’s somehow worth it to try to surmount the hurdle of immunity and attempt to reach the trial stage. Under this new dynamic, most prosecutors likely won’t even bother, no matter how horrific a president’s criminal actions may be.

This decision is a recipe for authoritarian rule. As Justice Sonia Sotomayor explained in dissent, it frees the president to engage in corruption and violence, including the assassination of his rivals , without fear of criminal charges. And it lets the president transform the executive branch into a fiefdom of self-enrichment and cruelty—wielding dictatorial power to entrench his own rule, then pardon every subordinate who facilitates any coup. The chilling logic behind this ruling seems to rest on a realistic understanding of how Republicans and Democrats exercise executive power; a reality we continue to witness on the Trump vs. Biden split screen. Trump intends to govern by punishing his enemies and rewarding his friends, issuing a ceaseless stream of executive actions that benefit his allies (billionaires, corporations, white nationalists, foreign dictators) and oppress the frequent targets of his ire (journalists, public servants, immigrants, women, minorities). The Supreme Court has now allowed Trump to carry out this agenda in a second term through literally criminal methods of repression so long as he calls them “official acts.”

Biden, by contrast, seeks to govern in a more traditional mode: Relying on federal agencies—staffed with nonpartisan experts who draw on a deep well of knowledge and experience—to carry out Congress’ commands. That is how American government has functioned for well over a century, to the great benefit of the citizenry. It’s why there is clean air and drinkable water and airplanes that stay in the sky and drugs that don’t kill us. And it is a model that the Supreme Court has now kneecapped.

Shortly before handing down Trump v. U.S. , the court issued Loper Bright Enterprises v. Raimondo , overturning a four-decade-old ruling that served as the basis for some 18,000 lower court decisions. Loper Bright abolished Chevron deference, the rule that federal courts should defer to agencies’ reasonable interpretations of ambiguous laws. By doing so, it seriously curbed Congress’ latitude to enact laws that address a serious problem then allow agencies to fill in the details and gaps. The ruling does not, as its defenders on the right like to insist , simply force Congress to “do its job.” Rather, it overrides lawmakers’ prerogative to exercise legislative power in a way they believe is necessary to protect the people from harms. It enshrines into law a specific conservative conception of proper government, overriding Congress’ choices without any constitutional mandate. And, of course, it replaces the opinions of agency experts with the political proclivities of life-tenured judges who may lack the most basic grasp of the facts. For good measure, the same conservative supermajority then erased a statute of limitations that might have staunched the coming tsunami of challenges to federal regulations.

Loper Bright boils down to a straightforward proposition: The Supreme Court’s Republican appointees are sympathetic to wealthy individuals and corporations, so they will contort the law to help them. That’s the story of other key decisions this term. In SEC v. Jarkesy , the conservative justices sabotaged agencies’ ability to bring civil penalties against lawbreakers, devastating their enforcement powers across the board. In Ohio v. EPA , they let polluters block vital environmental protections by second-guessing regulators’ scientific judgment. In Snyder v. U.S. , they let local officials accept bribes from wealthy benefactors in the form of (wink-wink) “gratuities.” In Moore v. U.S. , they deployed gratuitous rhetoric to preemptively stack the deck against a future wealth tax. In Garland v. Cargill , they let the gun industry continue making bank off de facto machine guns . Meanwhile, the court declared open season on the rights of everyone else: racial minorities , immigrants and their families , the homeless and disabled , women in need of emergency abortions —all were denied legal protections bestowed by the Constitution and Congress this term.

The Supreme Court has laid all the foundations for the demise of civil liberties for vulnerable communities, the restoration of a Christianity-based view of family and equality, the dismantling of the regulatory state, and an imperial presidency aided by a Justice Department that does the president-king’s bidding. Project 2025 sets forth the blueprint for achieving the rest. Had the high court remained a plausible check on a possible second Trump presidency, the next few years would have been challenging enough. Having shown themselves to be the rocket fuel powering this revanchist new world order, the six ultra-conservative justices have positioned themselves as partners in Trump’s fight.

There are conversations now taking place about what to do to reform a renegade court that refuses to accept that it should be checked by the other branches; those conversations have perhaps never felt more mired in helplessness, yet paradoxically, they have never been more crucial. Find someone working on court reform and lend an oar. Whatever faint hope we once held out that public outrage alone would encourage moderation has been blown to smithereens. Public outrage has somehow made the court more reckless. The time for wishful thinking about the power of shame, institutional legitimacy, and historical legacy is over. The time for action may well be now or never.
