Superyacht captain investigated on suspicion of manslaughter after deadly sinking

ROME — A multiple manslaughter investigation has been launched into the captain of a superyacht that sank in a violent storm off Sicily , killing British tech magnate Mike Lynch and five other people, his lawyer has told NBC News.

James Cutfield is also being investigated on suspicion of causing a shipwreck, the lawyer, Giovanni Rizzuti, said in a telephone conversation on Monday. He added that Sicilian prosecutors will question Cutfield, 51, again Tuesday.

In a separate interview Tuesday, Rizzuti said that Cutfield was expected to be questioned by prosecutors at around 3 p.m. local time (9 a.m. ET) at the hotel where the captain, crew and survivors have been staying following the shipwreck.

Being placed under investigation in Italy does not imply guilt and does not mean formal charges will necessarily follow. Notices to people under investigation need to be sent out before authorities can carry out the autopsies on the bodies of the dead.

It is unclear whether other members of the crew of the $40 million Bayesian or any other people will also be put under investigation along with Cutfield, a New Zealand national. 

After the luxury 180-foot vessel went down early last Monday, 15 of the 22 people onboard survived and were rescued from the waters off Porticello, a small fishing port off northern Sicily.

The body of Recaldo Thomas, a Canadian Antiguan national who was the ship’s cook, was recovered shortly after the ship went down. 

A massive search effort was then launched for Lynch and his 18-year-old daughter, Hannah, as well as Jonathan Bloomer, chairman of Morgan Stanley International and the British insurance firm Hiscox, and his wife, Judy; and a well-known New York City defense attorney, Christopher Morvillo, and his wife, Neda.

All of their bodies were eventually pulled from the wreck.

The Bayesian was owned by a firm linked to Lynch’s wife, Angela Bacares, who was one of the 15 people rescued after it capsized in what Italian officials called a “violent storm.” 

Built by Italian shipbuilder Perini Navi in 2008, the U.K.-registered Bayesian could carry 12 guests and a crew of up to 10, according to online specialist yacht sites. Its nearly 250-foot mast was the tallest aluminum sailing mast in the world, according to CharterWorld Luxury Yacht Charters.  

Lynch, who was regularly described in U.K. media as “Britain’s Bill Gates,” was acquitted by a San Francisco jury of fraud charges stemming from the 2011 sale of his software company Autonomy to Hewlett-Packard for $11 billion.

The Mediterranean sailing vacation was designed to be a celebration for Lynch, who took along those who appeared in his defense in U.S. court.

Announcing the opening of a manslaughter investigation at a news conference Saturday, prosecutor Ambrogio Cartosio said the sinking could have been caused by “behaviors that were not in order.”

Perini Navi sailing yachts for sale: 8 elegant sailers for adventurous sailors

‘It is because I sailed that I decided to create a boat that would fit my ideal specification,’ says Fabio Perini about how he set out to design his first yachts more than a quarter of a century ago. ‘I believe very passionately in the importance of sailing. I like to think I am doing my best to make that special time better for those who can afford it.’

To Perini, the oceans are one of the last real luxuries. ‘On land we all tend to flock to the most beautiful and popular places we can reach, which means they are always crowded. At sea, well, there’s an entire new dimension to things. The better the location the fewer people there are.’ This is one of the less publicised features of the Perini Navi school of yachts – there has always been debate about Perini’s captive winches, flying bridges and wide cockpits, but at their core the yachts themselves are comfortable, safe and easy globetrotters.

And here, spanning the 29 years of the Italian yard’s existence, are some Perini Navi sailing yachts that encapsulate those qualities along with their innovative design, cutting-edge technology and inimitable elegance, all needing new owners to take to the ends of the earth:

40m (1983/2008)

Perini Navi’s first ever yacht, Clan VI , launched as Felicità , was the archetype for all the Perini sailing yachts that would follow, and the first fully automated large cruising yacht. True to form she has circumnavigated the world. Built in steel with an aluminium superstructure, this motor sailer ketch was designed by Perini Navi and Dick Carter and has been refitted twice – in 2004 and 2008. Her well-proportioned interior sleeps 12 guests and carries 6 crew.

24.42m (1987/2008)

Built for Fabio Perini himself, Elettra is a real yachtman’s yacht. The sloop, originally named Marina, was the third yacht to be built by the yard, following Felicità and Christianne B . She has a Kevlar composite hull with a teak deck and an elegantly traditional teak interior with nautical styling.

Andromeda la Dea

47m (1990/2006)

Andromeda la Dea was the first Perini to circumnavigate the globe, and she has been on expeditions to both the Arctic and the Antarctic. A finely honed performance cruiser she has been refitted three times, most recently in 2006, and has all the technology and equipment to back up her limitless ocean cruising capability, and an uncompromisingly luxurious interior to cosset her guests no matter where in the world they are.

55.7m (2003)

The first of Perini Navi’s 56 metre series of yachts, Burrasca‘s proven sailing performance and handling, luxurious yet flexible accommodation and solidly reliable engineering and systems platform blazed the trail for nine (and counting) other individually customised versions, including Selene (see below) An aluminium hull rather than the yard’s former choice of steel combined with a slippery hull line optimised by Ron Holland, and a deep, ballasted centreboard gives her much improved sailing performance over her Perini predecessors. She began a world cruise immediately upon leaving Perini Navi’s Viareggio yard.

Felicitá West

64m (2003/2009)

When she was built in 2003, Felicitá West was the largest Perini Navi afloat, and as yet, has only been topped by Maltese Falcon . Her hull, designed by Ron Holland, was built in aluminium to produce a lighter boat with a better displacement-to-sail-area ratio, and Perini Navi combined forces with Nuvolari Lenard for her interior. A spectacular sailing machine, she has also been designed to provide the ultimate sailing experience with a huge flybridge where all 12 guests can sit, relax and socialise in the heart of the sailing action. The best views, however, are from the bow seat or the crow’s nest lift that ascends 40 metres up the rig.

43.45m (2004)

Ohana is an aluminium ketch with composite in-furling booms that was created for the generation of owners who would rather sail than use the engine in light winds. Like many of her Perini predecessors her naval architecture was optimised by Ron Holland, but her interior design was notable for representing a more modern approach by the Perini Navi design team. She has all the ergonomics and slick orchestration that mark a Perini right down to uncluttered sidedecks which enable guests to circulate easily despite the constraints of a large cruising yacht.

The fourth 56 metre to be launched by Perini Selene may share the qualities and attributes of her 56 metre sisters, but she has her own character and elegant innovations, among them a hydraulically opening transom, which contains a structural staircase descending to a wide bathing platform, a portside platform and some differences in layout including a larger, athwartships dining room forward of the saloon and a corridor allowing crew to move from the aft cockpit to the crew quarters without impinging on guest privacy. Her richly detailed and flawlessly executed art deco interior – accomplished by Perini Navi’s own designer Bernardo Chichi – won Best Sailing Yacht Interior at the 2008 World Superyacht Awards.

Perini Navi C 2173

A world-girdler of the future, the Perini Navi C 2173′s engine range will put her in the league of some explorer yachts, but with the wind in her sails, there will be no limitations. The sixth in the Italian yard’s 50 metre series, but only the second to be built in aluminium, C 2173 is sistership to Baracuda , launched in 2010. She will be ketch-rigged with a swing keel and centralised servo-assisted sail-plan controls. Her layout will accommodate up to 12 guests in five cabins, including a full beam owner’s suite, with interior design by Edge Design in the design studio’s first collaboration with Perini Navi. The yacht’s aluminium hull and superstructure with its mixed longitudinal/transverse structure were completed at Perini Navi’s Turkish yard, Perini Istanbul – Yildiz, but its outfitting will be carried out at the Viareggio yard in time for a spring delivery in 2012.

Perini Navi Megayacht ‘Bayesian’ Sinks off Italy: One Dead, Six Missing

The 184-ft Perini Navi sailing yacht Bayesian sank in a storm off Porticello in Sicily, the New York Times reported this morning. One person is confirmed dead, while six others are missing. It was reported that 12 guests and 10 crew were aboard, with 15 now rescued. The boat sank in 165 feet of water after being hit by strong winds at 5 a.m. Monday morning. Italian news reports the boat was hit by a waterspout.

One of those missing is British tech tycoon Mike Lynch, who sold his company to Hewlett Packard in 2011. He was cleared of fraud charges related to the sale in a San Francisco court in June.

At this point, the exact cause of the sinking is unknown. Reports are that the Bayesian was caught in a sudden weather event; its mast broke in the waterspout and the boat sank quickly, trapping some passengers in their cabins. According to the Times , “a fisherman in Porticello, told the Italian newspaper La Repubblica that he saw a waterspout” off the shore of Porticello shortly before 4 a.m. Soon after he saw a flare. The fisherman went to the site after the weather calmed, about 20 minutes later. There was floating debris but no sign of the ship.

Investigators are waiting to interview survivors and are diving on the yacht to determine what happened.

Supposedly at anchor but no protection according to map.

Seems odd: depth reported as ~50 meters, no protection. why would one anchor there? Possibly just drifting? I hope an actual mariner makes a report soon, for t he newsies don’t do well reporting maritime events.

The world is so small sometimes. Porticello is at latitude 38.1, and is the ancestral home of nearly all the Sicilian-American families who once made their living sailing out of Fisherman’s Wharf.

Presumably, the water spout knocked BAYESIAN down. Why did it fill with water and sink before righting itself ? It would be interesting to see the Capsize Screening Formula, the ballast/displacement ratio and the name of the naval architect.

Temperature that night at the nearby Palermo airport was around 80 degrees. Hatches & ports left open for ventilation???

This vessel uses a retractable keel. So, when in the up position, she would be much more susceptible to capsizing. A strong gust of wind could make it very unstable cause such an incident. Very sad.

must have a 50 ton keel……faced into wind and just flipped on its side…… but with retractable keel it makes more sense…..very sad.

The 24.4 metre craft was one of the first ever built by the shipyard, which ushered in a new era of elegance for large yachts that could still be handled by a small crew.

Petite compared with Perini’s greatest achievement, the Maltese Falcon , Elettra can more than hold her own at the annual Perini Navi Cup in Sardinia. Originally christened the Marina the yacht has a Kevlar – composite hull and kicks out a crusing speed of 10 knots.

With accommodation for seven guests and three crew members Elettra recently benefited from a total refit of all sailing systems undertaken by Perini Navi and has been the subject of constant upgrades and improvements over the years.

The interior remains an icon of classic maritime style, refreshingly bereft of all the over-decorated touches one finds on today’s floating behemoths.
